F-59-~Q.-38 B~ DENIED, WHEREAS, The City Planning Commission of the City of Anaheim has received a Verified Petition from the property owner(s) of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: Iluat portion of the northwest quarter of the northwest quarter of Section 13, Township 4 South, Range 11 West, in the Rancho Los Coyoves, in tile City of Anaheim, County of Orange, State of California, as per map recorded in Book 517 Page 11 of Miscellaneous Maps, in the office of the County Recorder of said coumty, described as follows: Beginning at a point on the north line of said section north 89° 41' 15" east 978.00 feet from the northwest corner of said section; thence south 0~ 10' 15" east 1338.43 feet parallel with the west li of said sect~3n to a point on the south line of the north half of the northwest quartcl said section, said point b~ng north 89° 37~ 30" east 978.00 feet from the intersection of said south line with the west line of said section; thence south 89~ 37~ 30" west 141.30 feet along said south line; thenc~ north 0° 10' 15" west 1338.59 feet parallel with the west line of said section to the north line of said section; thence north 89° 41t 15" east 141.30 feet to the point of beginning. Lincoln Avenue,Anaheim, California, as owners, request that the sub3ect property be reclassified from C-i, NEIGHBCP. HOOD COMMERCIAL to C-3, HEAVY COMMERCIAL. WN~.REAS, The City Pl-nning Commission did hold a lhAblic Hearing at the City Hall in the City of Anaheim upon said VERIFIED PETITION cf RECLASSIFICATION NO. F- 59-60-38 on the 2nd day of November , 1959 , NOTICE of which said Public Hearing was duly given as required b~ law end the provisions of %he ANAHEIM MUNIOIPAL CODE, Section 9200; and WHEREAS, Said Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said Hearings, does find and determine the following facts: 1. The property to the east is zoned C-3 and this was the basis for requesting that this property be similarly classified. 2. The 2nd property to the east owned by the same owner as the property ad3oininC the sub3ect property was originally given a variance for a m~tel which is a C-3 use, and later requested that the property to the west be rezoned to C-3 so that a restaurant and package liquor store be .b~lt. ~ese two uses fall in the C-1 category and the Planning Commission den~ed the C-3 reclassification, but same was consequently granted by the City Council 3. No uses were presented to tile Cor~aission by the applicant that did not fall in the C~i category. NOF, THEREFORE, BE IT RESOLVED THAT T~IE ANAHEIM CITY PLANNING COMMISSION HEREBY RECOMMENDS TO THE CITY COUNCIL OF THE CITY OF ANAHEIM THAT RECLASSIFICATION NO.
