WHEREAS, The City Planning Co~mission did hold a Public Hearing at the 0it¥ Hall in the City of Anaheim, on October 17, 1960 NOTICES of which said Public Hearing were duly given as required by law and the provisions of the ANAHEIM MUNICIPAL CODE, Section 9200; and ~1-- WHEREAS, Said C~..~ission, after due inspection,~estigation and studies made by itself and in i~behalf and after due considerat~ of all evidence and reports offered at said Hearing, does find and determine the following facts: 1. Althoagh the homes west of Sunkist St. have a minimum floor area of 1525 sq. ft., the Council resolution approving this Tract No. 2767 stipulated a minimum of 1350 sq. ft. of floor area. 2. Requested yard waiver appears to be most critical on the No. 6062 floor plan which has a S bedroom, 3 garage layout around a central patio. In some of these cases, the pro- posed rear yard is only 17 ft. However, they have one 20 to 25 ft. side yard which would compensate for the sHA'li09 ~ear!yard. S. Although the request constitt~s a:wAive~ .on practically the entire tract, the over all development appears to be a goo~ one and the .f2ontl Mards. which, ve~y from iS feet to 22 feet appear to be necessary in all but a £ew cases','bacause of the:proposed floor plans. ~, Lot No. SS and No. 63 did not meet the minimum side yard requirement on a reverse lot. Ample room is available, however, to make the necessary adjustments. $. No one appeared in opposition to the petition. NOW, THEREFORE, BE IT RESOLVED THAT THE ANAHEIM CITY PLANNING COMMISSION HEREBY GRANT~ VA~tIANC~ NO. 1307 POR A WAIV]E OP PROI~Ff~2ND P~ YARD SETBACK RRQUIP~NTS ON T~ACT NO. 2767, subject to the following conditions: 1. The completion of all improvements provided by final T~act No. 2767. 2. The provision of adequate side yards on Lots 58 and 63. S. Development in accordance with plans presented. ~ ~OP~GOING CONDITIONS are found to be a necessary prerequisite to the use of the property in order to preserve the safety and welfare of the gitizens of .Anaheim.
