BRADY, 203 South Monument Street, Anaheim, California, Owner of certain real property situated in the City of Anaheim, Caunty of Orange, State of California, as described in Sxhibit "A" or as follows: Lot 44, Tract No. 1940, and further described as 203 South Monumen~ Street. ; and Wf~RBAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on October 16, 1~61, at 2:00 o'clock P.M., notice of said public hearing havine been duly given as required by]aw and in accordance with the provi- sions of the Aaaheim Municipal Code, Chaptes 18.68, to hear and consider evi8ence for and agaiast said proposed variance and to investigate and mate findings and recommendations in connection thQrewith; and WF~RBAS, said Commission, after due inspection, iavestigatioa,and studq mada by it-~ self and in its behalf, and after due consideration of ali evidence and reports offered as ssid hearing, does find and determine the following facts: 1. That the petitioner sequests a variance• from the Anaheim Nunicipal Code: 9ection 18.24.030 (1) to permit an encroachment of fifteen (15) feet into the required twer_ty-five (25) foot front yard of sub,ject property in order to construct a six (6) foot fence. 2. That there are exceptional or extraordinary ci~cumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the aame vicinitq and zone. 3. That 4he requested variance is necessary for the ~reservation and enjoyment of a eubstantial property right possessad by other property in the same vicinity and zone, and denieri to the property in question. • 4. That the =equested variance wili not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zane in wh3.ch the property is located, 5. That the requested variance wiil not adversely affect the Comprehensive Geueral Plan. 6. That the existing fence was recently constructed in violation of the Anaheim Municipal Code on an interim basis and that the petitioner has agreed to the necessity of its replacement with a six (6) foot masonry wall where said fence presently encroaches into tne required twenty-five (25) foot front yard. 7. That no one appeared in opposition to subject petition.
