A RESOLUTION OF TIiE CITY PLANNING COMMISSION OF THE CITY OI' ANAHEIM
THAT PETITION FOR VARIANCE NO. 1433 gE DENIED
WHEREAS, the City Planning Commission of the City of Anaheim did receive a vecified Petition for Variance fcom
GAIL YR.~Y, P. 0. Box 67, Anaheim, California, Owner of certain reai property situated in the
City of Anaheim, County of Orange, State of California,_as described in Exhibit "A" or as
follows; Lot 30, B1ock A, Tract No. 158, Hlk Park Tract, as per map thereof tecorded in Book
12, pa~e 8, Miscellaneous Maps Records of Orange County
; and
WHEREAS, the City Plenning Commission did hold a public hearing et the City Hell in the City of Aneheim on
December 2'r , 1961 at 2:00 o'clock P.M., notice of said publlc headng having been duly given es requiced by
lew and in accardance with the provisions of the Anaheim Municipel Code, Chepter 18.68, to hear and consider evidence for
and egeinst said pcoposed varience and to irtvestigete and meke finding's end recommendations in connection therewith;

WHEREAS, seid Commicsion, after due inspection, investigetion, and study made by itself end in its behalf,
and aEter due consideration of ail evidence and cepods offered as said hearing, daes find and determine the following
facts:
1. Thet the petitioner requests a eariance from the Aneheim Municipal Code: Section 18.28.010 to permit
the construction of four (4) dwelliag units on subject property; Section 18.28.030 (3) to per-
mit an encroachment of twenty (201 feet into the required rear yard; and Section 18.28.030 (4-b)
4o permit the proposed development of subject property having a lot area of 2,015 square feet
per dwelling uttit rather than the required 3600 square feet per dwelling unit.
2, That there are no exceptional or extraordinary circumstances or conditions applicable
to the property involved or to the intended use of the property triat do not apply g enerally to
the property or class of use in the same vicinity and zone.
3. That the req~ested variance a.s nat necessary for the preservation or enjoyment of a
substantial property right possessed by other pro~7ertyin the same vicinity and zone, and
denied to the property in question.
4. That the requested variance will be materialiy detrimental to the public welfare
or injurious to the property or improvements in such vicittity and zone in which the property
is located.
S. That the requested variance far the proposed development of four units on the subject
property is not compatible with flie existing R-2,.Two Pamily Residential, Zoning and the existing
development, consisting predominantly of single family residential•uses, of subject area.
6. That the p=oposed development of subject property with four multiple family residential
units would permit the over-crowding of said property, where~s a suitable development with three
units would be more compatible with the existing development in'subject area.
7. That verbai opposition by one owner of property in subject area was recorded against
subject petition. •-
