{1'H~tBAS, the City Planaing Commissioa of the City of Anaheim did receive a,verified
Petition for Var.iance from RINKER DHVBLOPMENT CORPORATION, P. 0. Box 2025, Anaheim,
California, Owner
of certain real property situated in the City of Anaheim, County of Orange, State of
California, as deacribed in Hxhibit "A'° or as followa: Bxhibit "A" on file in tlie office
of the Planning Department.

Wt~tBAS, the City Planning Commission did hold s public hearing at the City Hall in
the City of Anaheim on July 24, 1961 ai 2:00 o'clock P.M., notice of said
public hearing having been duly given as required by]aw tnnd in accordance with the provi-
sions of the Anaheim Municipal Code, Chapter 18.68~ 4o hear and coasider evidence for and
against said proposed variance and to investigate and mate findiugs and rPcommendatioas
in connectior_ therewith; ond
WHI3RBAS, said Commission, after due inaQection, investigation,and study made by it-
self and in its behalf, and after due consideration of all eeidence and reports offered
as said hearing, does find and determine the following facta:
1. That the petitioner requests a variance from t~e Anaheim Hunicipal Code;
9ection 18.32,060 to permit construction of two story apartment development within 150 feet
of property classified in the R A, Residential Agricu].tural, Zone.
2. That there are exceptional or extraordinary circumstancea or conditiona
applicable to the property involved or to the int~aded uae of the property that do not
apply geuerally to the p:o~erty or class of uae in the aar~e vicinity and zone.
3. That the requested variattce is necessary for the preaervatioa and eajoqmeat
of a eubstanlial property right possessed by other propert~ ia the same vicinitq and
zone, and denied to the property in questioa. •
4. That the requested variance wili not be materially detrimental to the public
weifare or injurious to the property or improvements in such vicinitv and zone in which
the property is located,
5. That the requested t-ariance will not adversely affect the Cemprehensive
General Plan.

are hereby faund to be a aecessary Frerequiaite to the proposed uae of the sub3ec4 pro-
perty in ordet to preaerve the safety aad general xeifare of the Citizeas Af Pinaheim:
1, Subject to reclassification of sub,ject property to the R-3, Multiple Pamily Resideatial,

2, Development substantiaily in accordance with Bxhibit "A; 1-il."
3, Installation of a six (6) foot masonry wall along all boundaries of subject psoperty
except for those portions reserved for futute street'extension where ultimate develop-
