Cochran, 2283 West Lincoln Avenue, A~at~eim, California~ Agent of certain real.propesty situated in the City of Anaheim. County of Orange~ State of California~ as described ia Hxhibit "A" or as follows: Bxhibit "A" on file in the office of the Planning ~epaztment. ; and Wi~ffiRBAS, the City Planning Commission did hold a public hearing at the City Hall ia the City of Anaheim on August 7, 1961 at 2:00 o'clock P.M., notice of sa~d public hearing having been duly given as required by]aw and in accordance with the provi- aions of the Anaheim Municipal Code, Ch~pter 18.68, to hear and consider evidence for and against said proposed variance and to investigate and mate findings and recommendations in connection therewith; and WF~RBAS, said Commission, after due inspectioa, iavestigatioa,and study made by it- self and in its behalf, and after due consideration of all evidence and reports offered as said hearing, does find and determine the following facts: •1. That the petitioner requests a variance from the Anaheim Nunicipal Code: 9ection 17.08.100 (c) to permit the creation of a reverse corner lot having a width of 70 feeti and Section 18.60.030 (4-b) to permit util.ization of an R A~ ~tesidential Agricaltural, parcel containing less than one acre in area, 2. That there are exceptional or extraordiaary circumstaaces oz condifiiona applicabie to the property involved or to the intended use of the property that do aot apply geaerally to the pxoperty or class of use ia the same vicinity and zone. 3, That the reyuested variance is n~cessary for the preaervation and ea3oyreeat of a iubstantiai property right possessed by other propertq ia the same vicinity and zone~ and denied to the propertq in question. ~ 4. That the requested. vuriance wiii not be materiaily detr.imental to the pubiic welfare or iajurious to the Property or improvements in auch viclnitq and zor.e in which the property is loca.#ed. ~ 5. That the requested variance wiil nat adveraely affect the ComqrehEnsive General Plan. 6. That the development of the subjr.ct property for residential purposes with lots ' containing a minimum of 10,000 square feet or more and a fromtage of 70 feet or more wouJ.d ~ie the highest and best use of the psoperty in the subject area. 7. That the extension of Della Street should be continued n~rtherly to interspct with Orangewood Avenue in order to preserve the public safety and welfas~t of the citizens of the City of Anaheim. 8. Aed.ication of 45 feet from the monumented centerline of Orangewoc3 Avenue. 2, Dedication of one-half the width of Della Lane to tie in with the northerly stub-end of Dell~ Lane as provided on Final Map of Tract No, 3816 and as shown on the 8uilding Permit plot plan filed with the Building Department and stamped by the Planning Departmen: on April 3~ 1961. , . 3, Preparation of street improvement plans and iristallation of all improvements for Orange- wood Avenne and Della Lane, as dedicated, in accordance with approved standard plans on file in the Office of the City Engine~r, 4. Preparation of engineering plans fo; drainage facilities a~d the installation of said £acilities as approved by the Bngineering Division to'provide for natural drainage from Tract No, 3816 westerly along the southern boundary of subject property with provisions made for drainage under Della Lane to the southwest cdrner'of~the subject property. 5. Payment of $2,00 per front foot for ornamental street lighting purposes along Orangewood Avenue anc! Della Lane, said footage to be calculated on the frontage of subject property after dedication for said streets, or installation of street lights in conjunction with the street lighting plan for Tract No, 38Y6 to the satisfaction of the Director of P~blic Utilities. 6, Payment of $25.00 per dwelling unit Park and Recreation Fee. 7, Time limitation of one hundred eighty (180) days for the accomplishment of Item Nos. 1, 2, 3, 4, 5, and u.
