WHBEtBAS, the City Planning Commission did hold a pubiic heariag at the City Hall in
the City of Anaheim on August 21, 1961 at 2:00 o'clock P.M., notice of said
public hearing having been duly given as required by]aw and in accordance with the provi-
sions of the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidence fr~r and
against said proposed variance and to investigate and make findings and recomrrendatioas
in coanection therewith; and '~c
W1~RRBAS, said Commission, afier due inspection, investiigatioa,and study made by it-
seZf and in its behalf, and after due conside=ation of all evidence aad reports offered
as said hearing, does find and determine the following facts:
l. That the petitioner requests a variance from the Anaheim Muaicipal Code:
9ection 18.32,080 (2) to permit construction of residential units r:ithin five (5) feet of
ths side hroperty line; Section 18.32.060 to permit two story construction within 150 feet
of property classified in the R-1, One Family ResidenYial Zone; and Sectioa 18.32,080 (3)
to permit rear yard vehicle access area with a depth of 24 feet.
2. That there are excep4ional or extraordinary circumstances or conditiona
applicable to the proQerty involved or to the intended use of the property tha,t do not
apply generally tu the property or class of use in the same vicinitq and zone.
3, That the requested variance is necessary for the preservatioa and en,~oyment
of a Bubstantial property right possessed by other property in the same vicinity and
zotte, and deniecl to the property in question,
4. That tlie requested variance wiil not be materially detrimental to the public
welfare or iujurious to the property or improvements in such vicinitq and zone in wh3.ch
the property is located.
S. That the requested variance will not adversely affect the Comprehensive
General Plan.
6. That no one appeared in opposition to sub,;ect petition.
