RICH, 2536 Greenlea£, Anaheim, California, Owners, R. D. Davis, 1777 Newport Boulevard, Newport Beach, California, Agent of certain real property situated in the City of Anaheim, County of Orange, Stute of California, as described in Exhibit "A" or as follows: Lot 65,Tract 2118. ti; (i ; an3 Wie~RBA3, the City Planning Coe~mission did hold a public hearing at the City Hall in the City of Anaheia on August 21, 1961 at 2:00 o'clock P.M., notice of said public hearing having beerd duly given as required by]aw and ia accordaace with the provi- ; sions of the Anaheim Muaicipal Code, Chapter 18.68, to hear and consider evidence for and against said proposed variance and to investigate and make findings and recommendations in connection therewith; and ' iVE~RSAS, said Commission, after due in~pection, i.nvestigation,and s4udy made by it-~ self and in its behalf, and after due consideration of ail evidence and reports offered as said hearing, does find and determine the followiag facts: 1, That the petitioner requests a variance from the Anaheim Municipal Code: 3ection 18.24.030 (3) to permit an encroachment of twelve (12) feet in the required rear ;s yard of subject property in order to construct a family room addition to an existing residence. ; ~ 2, That there are exceptional or extraordinasy circumstances or conditions ~ applicable to the property invoived or to the intended use of the property that do not apply generally to the property or ciass of use in the same vic3nity and zone. ~3 3, That the requested variance is necessary for the preservation and en,~oyment of a 6ubstanYial ,property right possessed try other property in the same vicinitq and : zone, and denied to the property in question. • ~ 4. That the,reqsested variance will not be materially detrimental to the public welfare or injurious to the property or impronements in such vicinity and zone in wh9.ch ~ the property is located. :, 5.
