THAT PBTITION FQR VARIAN(`.H NQ. I396 BB GRANTHD
h~IHEtBAS, the City Planning Comui?sion of the City of Anaheim did receive a verified
Petition for Variance from MRS~ BE.L&~IWAP~D, 332 Kendor Drive, Anaheim, California, Owner
of certain real property situated in the City of Anaheim, County o£ Orange, State of
California, as described in Bxhibit "A" or as follows: Lot 22, Tract 3099
; and
WHBRBA3, the City Planning Commission did hold a pubiic hearing at the City Hall in
the City of Anaheim on August 21, 1961 at 2:00 o`clock P.M., notice of said
public hearing having been duly given as required by]aw and in accordance with the provi-
aions of the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidence for and
against said proposed variance and to investigate and mate findiags and recommendations
in connection therewith; and
W~RHAS, said Commission, after due inspect3on, investigation,csnd study made by it-
self and in its behalf, and after due consideration of ali evidence and reports offered
as said hearing, does find and determiae the following facts:
~1. That the petitioner reques.+.s a variance from the Anaheim Municipal Code:
Section 18.04.090_(2-h-1) to permit the r_onstruction of an eight (8) foot fence~
2. That there are exceptional or extraordinary circumstancea or conditions
applicable to the property involved or to the intended uae of the property that do aot
apply geaerally to the property or class of use in the same vicinity and zone.
3. That the requested variance is necessary for the preservation and en3oqment
of a aubatantial property right possessed by other property in the same vicinity and
zone, and denied to the property in question. •
4. That the requested variance will not _be materisily detrimental `to the public
welfare or injurious to the property or improvements in such vicinity and zone in w~i.ch
the propesty is located.
5. That the requested variance will not adversely affect the Comprehensive
General pian.
6. That the maximum height of the existing wall is hereby established at eight (8?
feet and that the approval of the subject patition is limited to the existieg eight (8)
foot wall only. ~
?. That verbal opposition by one owner of abutting property to the east, in respect
to the manner of the construction•of the wall-on subject property, was recorded against the
subject petition, although no objection was recorded in respect to the waiver of the height
limitation. Ttvo letters of support for the subject petition were filed with the Com'mission.
