~SA3, the City Pleaning Commission of the City of Anaheim did receive a verified
petition for Variance from BDWARD G. VAi.HR, Star Route, Lake Isabeila, California, Owner
of certain reai.proper4y situated in the City of Anaheim, C~unty of Orange, State of
Califoraia, as described in Exhibit "A" or as follows: Lot Nos. 3 and 4 of Tract 3266

WHHRBAS, the Citq Planaing Commission did hold a public.hearing at the City Hall in
the City of Anaheim on August 21, 1961 at 2;00 o`clack P.M., aotice of said ?
public hearing having been duly given as required by]aw and in accordance with the provi- '
aions of the Anaheim Municipal Code, Chapter 13.68, to hear aad consider eeidence for and .
against said proposed variance aad to investigate and aate findings and recommendations f
in connection therewith; and
WI~RBAS, said Commission, after due inspection, investigation,and study made by it-
• self and in its behalf, and after due ce,nsideration of all evidence and reports offered
as said hearing, does find and determiae the following facts:
1. That the petitioner requests a variance from the Anaheim Municipal Code: ~~
3ection 18.32,060 to permit constzuction of a two stor.y apartment development within 150 ~i
' feet of property classified in the R-1, One Pamily Residential, Zone.
2. That there are exceptional or extraordinary circumstancea or coaditiona
applicable to the property involved or to the intended use of the property tFtac do not
apply generally to the propertq flr class of use ia the same r•icinity aad zone.
3, That the requested variance is necessary for the preservation aad en3oyment
of a aubstantial property right possessed bq other property in the same vicinity and
zone, and denied to the property in question. •
4. That the requested variance will not be materially detrimental to the public
welfare or ir~jurious to the property or improvements in auch vi~cinity and zone in whi.ch
the property is located,
5. That the requested variance w:til not adversely affect the Comprehensive
la2uca :~ D18P_. '
6. That the abutting properties to ilie north and south had been developed for two-
story construction unddr the R-3, Multiple Pamily Residentiai, Zone requirements in effect
at the time of their construction.
7. That no one appeared in opposition to subject petition.
