WI~itBAS, the City Planning Commisaion of the City of Aaaheim did receive a~eerified
Petition for Variaace from LINUS J: end PATRICIA H. MAGHE, 239 Primrose Street, Anaheim,
California, Owners;
of certain real property situated in the City of Anaheim, County of Orange, State of
California, as deacribed in Sxhibit "A" or as follows: Lot 158 of Tract No. 2299.,

N'f~ItBAS, the City Planning Commission did hold a public hearing a4 the City Hall ia
the City of Anaheim on September 6, 1961, at 2:00 o~clock P.M., uotice of said
public hearing having been duly given as required by]aw and in accordance wit~ the provi-
sions of the Anaheim Municipal Code, Chupter 18.68, to hear and coasider evidence for aad
against said proposed variance aad to investigate and make findings and recommeadations
in connectioa therewith; and
WFffiRBAS, said Commission, after due inspectioa, invcstigation.ana atudq made by it-
self and in its behalf, and after due consideration of a11 evidence and reports offered
as said hearing, does find and determiae the following facts:
•1. That the petitioner requests a variance from the Anaheim Nunicipal Code;
9ection 18. 24.030 C3) to permit encroachment of 17,feet into the required rear ysrd of
subject property,in order'to zilow the constraction of a room addition to an existing
residence.
2. .That th~:re are exceptionai or extraordinary circumstancea or conditions
applicable to the property involved or to the intended uae of the property that do aot
apply generaliy to the property or class of use in the same viciaitq and zone.
3, That the requested variance is neceasary for the preaervation and ea3oyment
of a substanLial property right possesaed bp other praperty in the same viciaitq and
zonr, and denied to the.property in qneation. . •
4.; That.the requeated variance wili „ot be materiaily detrimeatal to 4he public
weifare or ia,jurious to the property or improvements in such vicinity and zone in which
the property is located. ~
5. That the requeated variance will nnt adveraely mffect the Conprehensive
General Plan:
