WF~A8A3, the City Planning Commiasion of the City of Anaheim did receive a verified
Petition for Conditional Use Permit from B.I.C, ~ BALL and MAGNOLIA, a limited partnership,
Suite 704, 9U0 North Broadway, Santa Ana, Ca13.fornia, Owners
of certain real property situated in the City of Anaheim, Couaty c•f Or~nge, State of
California, as described in Bxhlbit "A" or as follot~s: Legal description, Hxhibit "A", on
file in the office of the Planning Aepartment~

WF~R8A3, the City planning Commission did hold a public hearing a4 4he City }iall ia
the City of pnaheim on September 18, 1961 at 2:OU o~clock P.M., aotice of eaid
public hearing having been duly given as required by]ap and in acc4rdaace a3th the provi-
sions of the Ar.aheim Municipal Code, Chapter 18.64, to hear and coasider evidence for aad
against said proposed conditional uae ancf to iavestigate and make findinga and recon~en-
dations in connection therewith; and
WFIDRBAS, sAid Coa,mission~ after due inspectioa~iavestigation, and atudy made by it-
self and in its behal,t, and after due conaideration of all eviCence and reporta offered
at said hearing, does find and de~esmine the following facta;
1. That the proposed use ~ properly one for which a Coatlitional Use Pernit
is suthorized by this Code~ to wit; a walk-up restaurant.
2• ~at the proposed use will not adversely affect the ad,~oining laad uaea and
the growth and development of the area in which it is propoaed to be located.
3• That thr size and shape of the aite propoaed for the use ~,_ adequate ~to
allow the full deveiopment of the proposed uae in a manner aot detrimental to the parti-
cular area nor to the peace, health,•safety, aad generai xelfare of the citizeas of the
City of Aanheim.
4• That the traffic generated by the proposed uae wiil not impose an undue bur-
den upon the streets and highways deaigned aad isproved to earry the traffic in the area,
5• That the granting of the Coaditionai Uae Permit under the conditioas i~poaed~
if aay~ will no be detrimentai to the peace, heaith, safety, and geaeral xeifare of the
citiaena of the C34y of Aaaheim.
6, That the proposed sign size and location, indicated on Bxhibit No. 2,, is ttot
a part of the approval of subject petition.
7. That no one appearen in opposition to the subject petitic,n.

approves Conditional Use Permit No. 159 , upon Yhe following coaditioas which
are hereby foun3 to be a necessary prerequiaite to the proposed use of the aub,~ect pro-
pertq in order 4o preaerve tLe safety snd general~orelfare of the CiLizena of Anaheim:
1. Develo,ment subs:antially in accordance with Sxhibit Nos. 1 and 2, and iu accordaace
with Petiiion for teclassification No. 60-61-83.
~. Provision of areas for adequate trash storage and pickUp as determined by the
i°na**~::nt of Public Works.
3. Installation of the remaining sxdewalks and paving in accordance with the approved
standard plans on file in the Office of the City Engineer.
4. Time limitation of one hundred eighty (180) days for the accomplishment of Item No. 4.
