APPROVED WHEREAS, the City Planning Commission of the City of Aneheim did receiee a verified Petition for Recles'sifica- tionfrom BALL-BROOI{HURST COARAL, COMPANY, 1214 South Brookhurst Street, Anaheim, California, Owner; Gail Guthrie, 2235 Coronet, Anaheim, California, Agent; pzoposing reclassification of the following described property; The westerly 180.00 feet of the northerly 173,00 feet of Lot 1 of Tsact No. 162 as shown on a map 4hereof recorded in Book 12, page 6 of Miscell- aneous Maps, records of Orange County, California, said distances being measured along the northerly and westerly lin2s of said Lot 1, and said lot lines being 30.00 feet southerly of, and 30.00 feet easterly of the centerlines of Ball Road and Biookhurst Street, respectively ; and WHEREAS, the City Plenning Commission did hold a public hearing at the City Heli in the City of Aneheim on January 8, 1962 at 2:00 o'clock P.M. notice oE said public hearing having been duly given as required •by latv and in eccocdance with the pro~~isions of the Meheim Municipel Code, Chepter 18.72, to hear nnd consider evidence for and egeinst seid pfoposed reclassification and to invesligate snd meke findings and cecom~mendetions in connection therewith; and . WHEREAS, said Commission, after due inspection, investigation, end study mede by itself end in its behalf, and a$er due considecation of all evidence and reports offered at seid hearing, does find and dete~mine tha following facts: 1. That the petitioner proposes e reclessification of the ebove described properry from the C-1, NSIGHBORHOOD COMMHRCIAL, 20NH to the C-3, HBAVY COMMHRCIAL, ZONS (limited to Service Station use only). 2. That the proposed ceclassificetion of subject propecty is necessery end/or desirable for the orderly and pra per develapment of the corcmunity. 3. Thet the proposed ceclessificetion of subject property does properly relete to the zones end their pemiitted usea locally established in close proximity to subject property and to ihe zones and their permitted uses Renereliy esteb- lished throughout the conimunity. • 4. That the F~roposed reclassification of subject property does not require dedication for and standard i~nprovement of abutting streetis because said property does relate to and abut upon streets and highways which are improved to carry the type and quantity of traffic, which will be generated by the permitted uses, in accordance with the circulation element.of the General Plan. ~ 5. That compliance with Code, Section 18.40.030 for the ~rovision of the required amount of parking. area for the Ball-Brookhurst Corral Shopping Center will require the revision of the piesent pasking area layout of said ~roperty. 6. That vexbal opposition by two tenants in the Ball--Brookhurst Corral Shopping Center, in addition to one letter of protest, was recorded against subject petition. A statement of support signed by twelve tenants was recorded in favor of subject petition. f ` ~ ! Development substantiall.y in accordance with Bxhibit Nos. 1 and 2 with the architecture of the proposed service stairion conforming with the existing Ball-Brookhu~st Corral Shopping Center. 2. Recordation oi C-3, HBAYY COMMHRCIAL, ZO:VB.deed restrictions limiting the use of subject property to service station use c+nly. 3, Time limitation of one hundred eight~y (180) days for the accomplishment of Item No. 2, THE FOREGOING RESOLUTION is signed and epproved by me this 8th day of Januar~, 1962.
