SERIES 1961-62 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT Ztl~ BE GRANTED WHEREAS, the City Plenning Commission of the City of Aneheim did receive a vedfied Petitioa for Conditionel Use Permitfmm LUTHBRAN HOME ASSOCIATION OF CALIPORNIA, 891 South Walnut Street, Anaheim, California, Owner of certain real property situated ia the City of Anaheim, County of Orange, State of California, as described in Exhibit "A", or as follows; Legal description marked E~ehibit "A", attached hereto, incorporated in file of subject petition and referred to herein as though set forth in full ; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hell in the City of Aneheim on Pe~ruary 5, 1962 ot 2:00 o'clock P.M., notice of said public hearing havitig been duly given as required by lew and in accordance with the provisions of the Maheim Municipal code, Cheptec Il8.64, to hear end consider evidence for and against said pcoposed conditionel use and to investigate and melce findings and cecommeadatFons in connection therewlth; end ~ WHEREAS, said Commission, after due inspection, iavestigation, end study made by itself and in its behalf, and after nue aonsidecetion of all evidence end reports offered at said headng, does find aad determiae the following facts: 4 1. That the proposed use is properly one for which e Conditioaal .Use Permit is authorized by this Code, to wit: expansion of an existing home for the aged. 2. Thet the proposed use will not adversely effect the adjoining laad uses snd the gmwth end development of the area in which it is proposed to ba loceted. 3. That the eize artd ahape of the site pcopoaed for the use is edequete to allow the full development of the proposed use in a manner not detrimental to the particvler erea nor to the peece, health, safety, a~d generel welfere of the Citizens of the City of Anaheim. 4. That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and proposed to carry the traffic ~in the area. 5• That the gra~ti~g of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety, and general welfare.of the citizens of the City of Anaheim. 6. That it is hereby deemed necessary, in order to permit the development of sublect property in accordance with the plans submitted, that the waiver of the following sections of the Anaheim Municipal Code be granted as authorized by Code, Section 18.64.070: ~ a. Waiver of Code, Section 18.16.020 to permit the construction of a three (3) ' story building: b. Waiver of Code, Section 18.16.030 (1 and 3) to permit the existing buildings to extend into the required front and rear yards. c. Waiver of Code, Section 18.16.030 (4-c) to permit a density of single dwelling i;-:it i:onstruction in excess of one family per 6,000 square feet of lot area. 7. Development substantially in accordance with Exhibit No. 1 with plans for the future development of an additional 75 uni.ts on the westerly po~tion of subject property to be submitted to the Planning.Commission for approval prior to development. 2. Provision of parking facilities as required, said parking to be provided on the site of subject property. 3, Dedication of 53 feet from the centerline of Ball Road westerly 442 feet plus or minus of subject parcel. (30 feet existing). 4. Dedication of 362 feet from the centerline of Ball Road approximately 160 to 200 feet west of the easterly property line of subject property (35 feet existing). 5. Payment of $2.00 per front foot for street lighting purposes on Ball Road. 6. Installation of sidewalks along the westerly 368 feet plus or minus Ball Road frontage of subject property in accordance with the adopted standard plans on file in the Office of the City Engineer. 7. Installation of a 4 foot wide sidewalk along the easterly 274 feet plus or minus Ball Road #rontage of subject property subject to the approval of the City Engineer. 8. Provision of trash storage areas as determined by the Department of Public Works, Sanitation D.ivision, which are adequate in size, accessible to trash-truck pick-up and adequately enclosed by a solid fence or wall, prior to Final Building Inspection. 9. Time limitation of one hundred eighty (180) days for the accomplishment of Item Nos. 3, 4, 5, 6, and 7.
