CLARK, 222 West Whiting Avenue, Pullerton, California, Owner of certain real property situated in the City of Anaheim, County of Orange, State of California, as described in ID~hibit "A" or as follows: The easterly 127,00 feet of the westerly 317.00 feet of the southerly 200.0~) £ee~ of the southwest quarter of Section 5, Township 4 3outh, Range 10 West, in the Rancho Los Coyotes, as ;;hown on a Map recorded in Book 51, Page 10 of Miscellaneous Maps, records of Orange County, Galifornia ; end WHEREAS, the CiQy Planning Commission did hold a public headng et the City Hatl in the City of Aneheim on Pebruary 5, 1962 at 2:00 o'clock P.M., notice of said public hearing having been duly given ae tequiced by law end in ecco~dence with t~he provisions of the Aneheim Municipal code, Cheptet 18.64, to hear end coasider evidence for end against said proposed conditionel use end to inveatigete and meke findiags ead cecommendetions in connectlon Wecewith; end ' WHEREAS, said Commission, efter due inapection, investigetion, end study made by itself and in its behelf; aad after due considecation of all evidence end repode offered at aeid headng, does find end dete~ine the following facts: 2. Thet the psoposed use is properly one for which a Conditionel.Use Permit is authorized by this Code,to wit: a walk-up restaurant. 2. Thet the proposed use will not adversely effect t.he adjolning lend uses end the gcowth end dovelopment of the acea in which it is proposed to be located. 3. Thet the size and shape of the site proposed for the uae is adequete to allow the full development of the proposed use in a manner not detdmental to the pacticuler area nor to the peece, health, sefety, end general welfare of the Citiaens oE the City of Maheim. 4. Tha't the 'traffic generated by the proposed use will not impose an undue burden upon the sYreets and highways designed to carry the traffic in the area. 5• That the granting of the Conditional Use Permit under the conditions imposed, if any, wili not be detrimental to the peace, health, safety, and general welfare of the c~tizens of the City of Anaheim. 6. Development substantially in accordance with Exhibit Nos. l, 2, 3, and 4, with the provision that plans be modified to provide a twenty-five (25) foot building setback from the property line to the point of overhang. i 2. Installation of tree wells at forty (40) foot intervals in the parkwaY portion of sub- , ject property with the installation of trees, plans for said landscaping to be submitted to and subject to the approval of the Superintendent of Parkway Main.*.enance and to be installed prior to Finai Building Inspection. 3. Provision and maintenance of adequate trash receptacles prior to Final Building Inspection. 4. Dedication of 53 feet from the monumented centerline of La Palma Avenue, (50 feet existing). 5. Installation of sidewalks and driveways on La Palma Avenue in accordance with the adopted standard plans on file in the office of the City Engineer. 6. PaymPnt of $2.00 per front foot for street lighting purposes on La Palma Avenue. 7. Provision of a 5 foot utility easement along the east boundary of subject property to adequately serve the subject property and other properties, at the time of the installation of service faciiities. 8. Proposed easterly driveway to be moved to west so top of apron is one (1) foot clear of property line., 9. Time limitation of one hundred eighty (180) days for the accomplishment of Item Nos. 4, 5, and 6. THE FOREGOING RESOLUTION is sig~ed ead approved by me this Sth day of February, 1962.
