DOHSKBN, 2748 West Ball Road, Anaheim, Califorhia, .~wner; G. G. Lamkin, 730 West I{atella Avenue, Anaheim, California, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, as described in Exhibit "A" or as follows: The west 132 feet of the east 661 feet of the north half of the northwest quarter of the northeast quarter of 5ection 24, Township 4 South, Range 11 West, in the Rancho Los Coyotes, as shown on a Map recorded in Book 51, page 11 of Miscellaneous Diaps, records of Orange County, California ; and WHEREAS, the City Planning Commission did hold e public hearing et 4he City Hell in the City of Anaheim on March 5, 1962 et 2:00 o'clock P.M., notice of said publlc headng heving been duly g~ves~ ea required by law and in eocordence with the provisions of the Meheim Municipel Code, Chapter 18.68, to hear and conaider evidence for and against said propased varience and to investigate end make finding's end recommendetlons in connectioa therewith; end WHEREAS, seid Commission, eEter due inspection, investigation, end study made by itself and in its behelf, and after due consideeation of ell evidence and reports offered es said headng, does find and detecmine the following fecta: 1. Thet the petitioner requests a vedance from the Aneheim Municipel Code: Section 18.32,060 and Section 18.32,090 for waiver of wall and single story height requirements. 2. That there are~no exceptional or extraordinary circumstances or conditions applicaUle to the property involved or to the intended use of the property 4hat do not apply generally to the property or class of use in the same vicinity and zone. ' 3, That the requested variance is not necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 4. That the requested variance will be materially detrimental to the publzc welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 5. That at the present time there is a problem of drainage and flooding in the subject area which necessitates consideration before development of subject area is established. 6. That the proposed two story multiple family residential development of subject property would permit an encreachment into the R-1, One Pamily Residential, development in subject area, 7. That a more suitable plan for the ultimate development of the suoject and abu#ting properties is possible and it is hereby suggested that the petitioners endeavor to develop plans which would promote the highest and best use of tlie subject property and for the ultimate development in the subject area. 8, That verbal opposition, in addition to a petition of protest c~ntaining 33 signatures, was recorded in protest to subject petition.
