PC 1961-1962-318t~ 4 :t ~ ~ i 1 ~ . ~i6` -~ ~ d ' 4 4~ .... ;.~ '~: ~~~ RESOLUTION NO.?~8o SERTES 1961-69 - ai - - A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAiiEIM TNAT PETITiON FOR CUNDITIONAL USE PERMIT 233 BE GRANTED `~ WHEREAS, the City Planning Commission of the City of Anehelm did receive a verified Petition for Conditional ~~ Use Permit from AGNES and ~ERRY DOLAN, Post Office Box 2, Anaheim~ Californiay Owner of certain `? xeal property situated in the City of Anaheim, County of Orange, State of California, as followsj Beginning at a point on the Easterly line of Lot 11, 652.8 feet South of the North- east corner of said Lot 11, and running thence Westerly parallel with the Northerly line of said L~t 11, 106 feet~ thence Southerly parallel' with the Easterly line of said Lot 11 to the Southerly.line thereof; thence Easterly along said Southerly line to the Southeasterly corner ~ of sai.d Lot 11; thence Northerly along the Easterly line ef said Lot 11 to the point of begin- ~ nings EXCEPTING THEREFROM the East 44 feet thereof; ALSO EXCEPTING THEREFROM the North 180.21 feet thereof ; and WHEREAS, the City Planning Commission did hold e public hearing et the City Hall in the City of Anaheim on ~ May~ 14~ 1962, at 2:00 o'clock P.M., notice of seid public hearing having been duly given as required by ~ law and in eccordance with the provisions of the Anaheim Municipal code, Chapter 18.64, to hear end consider evidence i for a-+~j against seid proposed conditionel use and to investigate and make findings aad recommendations in connection :~ thetewith; and WHEREAS, said Commission, after due inspection, investigetion, and study mede by itself and in its behalf, end after due considecation of all evidence end repods offered at said hearing, does find and determine the following fects: ~ 1. That the proposed use is pcoperly one foe which a Conditional.Use Permit is authorized by this Code, to wit: establish a child care nursery. _ 2. Thet the proposed use wi11 not adversely aEfect the edjoining land uses end the growth end development of the area in which it is proposed to be located. 3. Thet the size end shape of the site p~oposed for the use is adequete to allow the full development of the proposed use in a manner not detrimentel to the perticuler area nor to the peace, health, sefery, end general welfare of the Citizens of the City of Anaheim. 4. That the granting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimentel to the peace, health, safety, and general welfere of the Citizens of the City of Aneheim. 5. That th'e traffic generated by the proposed use will not i~pose an undue burden upon the streets and highways designed and proposed to carry the t.raffic in the area. 6. That no one appeared in opposition to sub~ect petition. 7. That two fully improved parking spaces shall be provided for employea oarking. ( , Cl-G -1- i ;~ .i . ~ r~. ~, ~;, : ~ ~ ` . t __} ~~, NOW, THEREFORE, BE ET RESOL1i~:D tha! the Aneheim City Plenning Commission does hereby gcant subject ~~ Petition for Condi4ionel Use Permit, upon the following conditions which ere hereby found to be a neaessary pre:equisite to the pmposed use of the subject property in ocder to p~eserve the safery and genecal welface of the Citizens of the City of Anaheim: ' 1, Development substantially in accordance with Exhibit No. 1, except that the structure be painted completely on.a11 .sfdes,.repair work to be done on all sides of subject structure, overhang on front of s! `,ure to be cut back to three inches and facia board to be placed on front of said overhang. 2. Provision for a solid board fence painted a sedwood finish, to be erected on the eas~, south and north side of subjec~t property, and a c.hain link fence erPCted across the front of subject prop~~rty facing La Palma Avenue. 3. Provision for parking f acilitie~ for two cars at leas~ ten (10) feet by twenty (20) feet, plot plans for said parking f acilities to be submitted to the Planning Depar.tment for ap- ~rovaL 4.Ins±allation of landscaping in the parkway portion of subject property, plans for said landscaping to be submitted to and sub~ect to the approval of the Superintendent of Park- way Maintenance, and s~id landscaping installed prior to issuance of a Business License. 5. Subject to Building Department inspection and approval of the existing structure for the proposed use, and that the improvements as stipulated by the applicant be approved before the issuance of a business license. 6. Limitation of children's play area to the side and back of sub~ect property. 7. Sub~ect to the written approval of the State Department of Social Welfare prior to the issuance of the Business License. 8: Dedication of fifty-three (53) feet from the monumented centerline of La Palma Avenue (50 f eet existing). ~ 9.
