RICHARD SMALL~ 94y McCloud, Anaheim, California, Owners: HARVEY L. LUCAS, General Contractar, 4517 Tiller Avenue, Orange~ California~ Agent of certain real praperty situated in the City of Anaheim, County of Orange, State of California as £ollows; Lot 71 in Tract 2259 and further described as 949 McCloud Avenue, Anaheim, California ; and WHEREAS, the City Planning Commission did hold a public heering et the City Hall in the City of Aneheim on May 28~ 1962' et 2:00 o'clock P.M., notice of seid pubiic heedng ha~ing been duly given es requi:ed by law end in accordence with the provisions of the Anaheim Municipal Code, Chepter 18.68,to heer and consider evideace for and against seid proposed variencP and to investigete end make findings and recommendetions in connec- tlon therewith; end WHEREAS, seid Commission, afte: due inspection, investigation, end study mede by itself and in its behalf, and efter due consideration of ell evidence and repods oEfered eF seid headng, does find and dete:mine the follow}ng facts: 1. Thet the petitioner requests a varience from the AnahPim Municipal Code: Sectian 18.24.030 (3) to per- mit the construction of an addition to exist3ng residence. 2. Thet thece ace exceptionel or extreordInery circumstences or conditions epplicable to the property involved or to the intended use of the property that do not apply generelly to the property or cless of use in the seme vicinity and zone. 3. That the requested variance is necessary for the preservation and enjoyment of a substantiel property right possessed by other propedy in the seme vicinity and zone, end denied to the propedy in question. 4. That the requested variance will not be meterieily detrimental to the public welfere or injurious to the pmp- edy or improvements in such vicinity and zone in which the propedy is located. 5. That the requested variance wiil not adveraely effect the Comprehensive General Plan. 6. That no one appeared in opposition to sub~ect petition.
