BE DENIED WHEREAS, the City Pianning Commiseio~ of the City of Maheiin did receive e verified Petition for Conditional Une Permitfrom ALBAN and BERNADINE HOLTZ, 534 West Laveta, OrangeT California, 0-mers of' certain real property situated in the City of Anaheim, County of Orange, State of California as described in Exhibit "A" attached hereto and referred to herein as though set forth in full ; and WHEREAS, Lhe City Flenning Commission did hold a public hearing at the City Hall in the City of Anaheim on May 28~ 1962, et 2:00 o'clock P.M., notice of ssid public headng having beep duly given as required by law and in accordence with the provisions of the Aneheim Municipel Code, Chepter 18:64, to hear end consider evidence for end against seid proposed conditionel use and to investigate and meke findinga end recommendetions in connection therewith; and WHEREAS, seid Commission, efter due inspection, investigetion, and study mede by itself end in its behelf, and efter due consideration of all evidence and eeports offeeed et suid hearing, does find end dete~mine the following fads: 1. Thet the proposed use is properly one for which e Conditional Use Pe:mit is aathorized by lhis Code, to wit: establish a service station. 2. That the proposed use will adversely affect the adjoining land uses and the grow- th and development of the area iri which it is proposed to be located. 3. That in a planning study the Commission went on record as opposi'ng the commercisi development at sup~eci: intersection, that there was adequate service station f acilities for the area, that there seemed to be no need for four service stations at sub~ect inter- section, and thet consideration should be taken as to the highest and best land use developieent for subject area. 4. That 18 persons aPeeared before the Commission in opposition to sub~ect_petitiqn; two persons presenting petitions with 120 signatures of neighboring property owners in opposition to subject petition.
