A. YIIIVGBLUTH, 815 West Broadway, Anaheim~ California, Owners GLENN P. FRY; 187 West Lincoln Avenue, Anaheim, California, Agent of certain real property situated in the City of Anaheim, - County of Orange, State of California, as foll~wss Original Building Lot 5, as shown on a map of L'ands of Anaheim, recorded in book 4, pages 629 and 630, Deeds, Records of Los Angeles County, California; Excepting therefrom that portion thereof as granted to Peter J.. Weisel in deed recorded January 6, 1904, in book 98, page 364, Deeds' records of said Orange Countyj'Also ' excepting therefrom that portion ther?of as granted ta Frederick W. Kellogg, in deed recorded March 20, 1923, in book 462, page 94, De~ds, records nf said Orange County ; and WHEREAS, the City Plenning Commission did hold a public headng et thc City Hell in the City of Maheim on June 11~ 1962 at 2:00 o'clock P.M., notice of seid publlc hearing having been duly g(ven es required by law end in axordence with the provisions of the Aneheim Municipal Code, Chepter 18.68, to hear end consider evidence for end against seid propased vecience end to investigate end meke finding's and recommendeti~ns in connection therewith; end WFIEREAS, seid Commission, efter due inspection, investigaUon, and study made by itself and in its behalf, and efter due coneideretion of all evidence and reports offered as seld heering, does find end determine the followiag fects: 1. Thet the petitioner requests a vedence from the Aneheim Municipal Code: SeCtiOn 18.44.010 t0 establish a furniture re-upholstering service. 2. That there are no exceptional or extraordinary circumstances or canditions applicable to the property involved'or to the intended vse of the property that do not apply generally to the property or class of use in the same vicinity and zone. 3. That the requested variance is not neCessary for the preservation and enjoyment of a substantial property right possessed by other propex•ty in the seme vicinity and zone, and denied to the property in question. 4. That the requested variance will be :naterially detrimental to the public welfare or in~urious ;;o the property or improvements in such vicinity and zone in which the property is located. 5. :hat the requested vsriance will adversely aifect the Comprehensive General Plan. 6. That the subject property would be incompatible with the proposed use~ 7. Thet no one appeared in opposition to subJect petition.
