~• A RESOLUTIOIJ OF THE CITY PLANNING COMMISSION OP' THE CITY OF ANAHEIM
,~; ` THAT PETITION FOR VARIANCE N0.1492 BE GRANTED •
WHEREAS, the City Plenning Cammission of the City of Anahelm did re~c:ve a vedSed Petition for Vedance
from MARSHALL R. and DOROTHY R. BAUCOM, 212 North Dale Avenue, Anaheim~ California, Owners
of certain real property situated in the City of Aneheim~ County of Orange, State of Cal-
ifornia, as followss The North 115.00 feet of the South 789.00 feet of the West 135.00 feet
of that portion of the West half of the Southwest quarter of the Southeast quarter of Section
12, Township 4, South, Range 11 West, in the Rancho Los Coyotes, as shown on a Map recorded
in Book 51, page 11 of Miscellaneous Maps, records of Orange County, California,Beginning at
the Southwest corner of the West half of said Southwest quarter; thence North along the West
l~ne of said West half, 1320 feet to the Northwest carner of said West half of the Southwest
quarter of the Southeast qnarter; thence East 330~feets thence South 1320 feetg thence West
330 feet to the point of beginning

WHEREAS, the City Pianning Commisaion did hold a pubHc headng et the City Fiell in the City of Aneheim
on June 11~ 1962~ et 2:00 o'clock P.M., notice of seid publir, hearing having been duly given es required
by law and in eccordence with the.provisions of the Anaheim Municipel Code, Chapter 18.68,to hear end consider
evidence for end against said proposed variance and to invas~igate end make findinge and recommendetions in connec-
tion therewith; and
PJHEREAS, said Commiaslon, after due inapection, inveatigation, ead study mede hy itself end in its behalf,
and aE4er due consideratioa of ell evidence snd reports offered as seid hearing, does find aad determine the following
facts:
1. Thet the petitioner requests e variance from the Aneheim Municipel Code: SeCtiOn 18.16.030 (2-b) to
construct aysi:ifQOt masonry wail along the side yard property line.
2. That tt~ere ace exceptional or extrao~dinery circumstences or conditiona eppliceble to the pruperty involved
or to the intended use of the propezty that do not apply generally to the property or cless of use in the same vicinity
end soae.
3. That the ceqaeated varience is neceasary for the preservation end enjoymen! of e substantiel property right
possessed by other properEy in the seme vicinity end zone, and denied to the property in question.
4. Thet the rrquested variance will not be matedelly detrimentel to the public welfste or injurioua to the pmp-
erty or improvements in such vicinity end zone in which the pmperty is loceted.

Aneheim. I
1. Dedication of 45 fQet from the monumented center.llne of _Dale Avenue (20 feet ex-
isting) including return.
2. Provision that a two-year bond be posted to insure the installa4 of street im-
provements of sidewalks, curbs and gutters on Dale Avenue, and should pio; _;:y abutting ta ~
the south be deueloped pr.ior to.the two years, said impiovements shall be instailed on
sub,ject property at the request of the City Engineer~ that should property abutting to the
south not be developed within the said two-year guarantee peri~d, the petitioner may re-
quest that said bond be renewed thraugh the City Engineer or City Attorney. •
3. Time limitation of one hundred and eighty (180) days for the accomplishment of Item
Nos. 1 and 2.
4. Develop~ent substantially in accordance with Er,hibit No. 1 provided'that said six
(6) foot wall shall be constructed parallel to Yale Avenue and three (3) f eet £rom the ~
right-of-way line of Yale Avenue.
