A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT248 BE GRANTED
WHEREAS9 the city Council of the Cit}~ of Anaheim did initiate a verif ied Petition for.a
Condiiional Use Permit for certain real property situated in the City of Anaheim~ Caunty of Orange9
State of Calif ornia, as dascribed in Exhibit "A" att~ched hereto and referred to herein as though
set forth in fullj ar~d
WHF.f2EAS, the City Planning Commission did hold a public hearing at the City Hall in
~ the City of Anaheim on June 11, 1962, at 2s00 o`clock P.M.y notice of said public hearing having
been duly given as required by law and in accordance with the provisions of the Anaheim Municipal
' Code, Chapter 18.72, to hear and consider evidence for and against said proposed Conditional Use
~~ Permit and to fnvestigate and make f indings and :ecommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation, and study made by itself
and in its behalf, and after due consideration of all evidence and reports offered at said
~; hearingy does fitxi and determine the following facts~
1. That the proposed use is properly one for which a Conditiona] Use Permit is authorized
`. by this Code, to wite a Multiple Family Planned Unit Development.
2e That the proposed use will not adversely affect the adJoining land uses and the
; growth and_development of. the area in which it is proposed to be located. •
- 3. That the size and shape of the site proposed for the use is adequate to allow
the full development of the proposed use in a manner not detrimental to the particular area
nor to the_peace;, health~ safety, and general welfare of the Citizens.of the City of Anaheim.
G; That the granting of the Conditional Use Permit under the conditions imposed, if
any, will iiot be detrimental to the peace, health~ safety~ and general welf are of the Citizens
of the City of Anaheim.
5, That the traffic yanerated by the proposed use will no•t impose an undue burden
; upon the streets and highways designed and improved to ~erry the traffiu~ in the area.
6. That no one appeared in opposition to sub~ect petition~~ .

NOW, THEREFORE, BE.IT RE~ ~VED.that the Anaheim City Plann~g Comm~ssion does hereby grant
siib~ect Petition for. Conditional Use Permi.t~ up~n the following condit~ons which are nereby ~
found to be a necessary prerequisite to thE orUposed use of the sub3ect property in order to ?
preserve the safety and•general welfare of the Citizens of the City of Anaheims ~
1. Acquire Lot A, Tract No. 2299, along the westesly side Gf Empire Street. ;
2: Dedication of. thirty (30) feet from the monumented ce.n'cer.line bf Empire Street !
(22 feet existing).
3. Provision of trash storage ar.eas as determined by the Department of Public Works,
Sanitation Di~ision,.which ar.e adequate in size, accessible to trash-truck pickup, and
adequately enclosed.by a solid fence.or wa11, prior to Final Building Ins~ection.
4. Installation of sidewalks and driveways on Empire Street in accordance with the
adopted standar.d plans on f.ile in the Of.fice of the City Engineex.
5. Payment.of a Park and Recreation Fee.of. $25.00 per dwelling unit to be collected
as part of the Building Permit. ;
6. Subject to the complianc,e and completion of Petition for Reclassification No. ~
61-62-110.
7. Time limitation of one liundred and eighty (180) days for the accomplishment of ~
Item Nos. l~ 2~ and 4.
8; Sub~ect to the reclassification of sub~ect property to the R-3r Multiple Family
Residential, Zone. `
9, Subject to.the installation of a six (6) foot masonry wall along all boundaries '
of subject property except the entire street frontage of Parcel No. 11, prior to Final ~
Building Inspection.
10• Dedication o£ all access .rights of sub,ject property for the entire street except
for those openings provided for the sole use of tenants and their visitors of sub~sct
development.
11. Limitation of 'recordation of deed restrictions limiting subject property to multiple
family residential purposes on1yY and limiting structural height thereof ~o fifteen (15) feet
above natural grade leveL
