A RESOLTJTInN OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR 9ARUINCE NO. 1494 BE GRANTED
WHEREAS, the City Planning Commission of the City of Aneheim did recelva a veri~ied Petition for Variance
from ARNOLD INVESTMENT ODMPANY, 2293 1NP:,t Ball Road, Anaheim, California, Ovuner; H. RALPH
IAVETT~ 4921 Durfee Avenue, Pico RivPra, California, Agent of certain real,property situated
in the City of Anaheim, County of Orange~ State of California as described in Exhibit "A"
attached liereto and referred to herein as though set forth in full

WHEREAS, the City Plenning Commission did hold e public headng at the City Hell ia the City of Ana~eim
on JUne 25~ 1962~ at 2:00 o'clock P.M., notice cf said public hearing having been duly given :s requiced
by law end in accordance wittt the ptovisions of the .4naheim Municipt+l Code, Cheptee 18.68, to hear end consider
evidence for end against said proposed veriance end to investigate end make findinga end recommendet?uns in conaec-
tion therewlth; end
WHEREAS, seid Commiasion, aftcr due inspectioa, investIgation, and study made by itself and in its behalf,
and after due consideration of ell evidence end sepods offeced as seid hearing, does find end detexmine the following
facts:
1. That Qhe petitioner requests a vatience from the Maheim Municipel Code: Section 18.40.010 to permit
the on-sale of beer in connection with a pizza restaurant.
2. That the:e ece exceptioael or extraordinary circumstences or conditione applicable to the property involved
or to the intended use of the property thet do not epply gene:ally to the property or cless of use in the seme vicinity
and zone.
3. That the requested verience ia necessary for the preservation and enjoyment of a substantial property right
possessed by other property in the same vicinity end zone, and denied to the ptoperty in question.
4. That the requested veriance will not be materially detrimental to the public welfate or injurious to the pmp-
erty or improvements in such vicinity end zone in which the property ia located.
~ 5. That the cequested variance will not udversely affect the Comprehensive General Plen.
6. That no one appeared in opposition to subject petition.

NOW, THEREFORE, BE 1T RESOLVED thet the Aneheim City Planning Commisslon does he:eby grant subject
Pet3tion for Variance, upon the following condltions which are hereby found to be a necessary precequisite to the pro-
posed use of the subject propedy in order to preserve the safety end generel welfare of the Citizens ofthe City of ;'
Aneheim. r
1. Installation of a minimum six foot wide landscaping strip abutting the Brookhurst
Street Right-of-way line, plans for said landscaping to be submitted to and sub~ect to {
the approval of Superintendent of Parkway Maintenance and said landscaping to be installed . '?
prior to final building inspection. ~
2. On-sala of beer to be permitted in connection with the pizza restaurant operation ~
conducted by the present owner only.
