A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHGIM
THAT PETITION FOR CONDITIONAL USE PERMIT 269 BE ~~ANTED
WHEREAS, the City r:anning Commission of the City of Anaheim did receive a verified PetitIon for Conditional
Use Permit from WILLIAM LYON, 552 Miguel Place, Fullerton, California, Owner; Nu'2. MASON CASE,
1105 'r~ilshire Boulevard,.Los Angeles 17, California, Agent of certain real property situated
in the City of Anaheim, County of Oranc,e, State of California as described in E~chibit "A"
attached hereto and referred to herein as though set forth in full

WHEREAS, the City Plaaning Commission did hoid a public heering at the City Hall in the Ci4y of Anaheim on
JUly 9~ 1962~ at 2:00 o'clock P.M., notice of said public hearing having been duly given as reqaired by
law and in accordance with the provisians of the Aneheim Municipal code, Chepter 18.64, to hear ead consider evidence
for end against said proposed cronditional use end to investigete and meke findings and recommendetions in connection
therewith; and ,
WHEREAS, said Commission, afte; due inspection, investigation, and study made by itself end in its behalf, and
aEter due consideretion of all evidence and r~~~rts ofEered at said hearing, does find end determine the following fects:
1. Thet the propesed use is properly one for which a Conditional .Uae Permit is authorized by this Code, to
wit: a walk-up restaurant.
2. That the proposed use will not adversely affect the adjoining land uses and the growth end development of
the area in which it is proposed to be loceted.
3. Thet the size and shepe of the site proposed for the use is adequate to allow the full development of the
proposed use in a manner not detrimentel to the pediculer area nor to the peace, health, sefety, and genera! welfere
of the Citiaens of the City of Maheim.
4. Thet the granting of the Conditional Use Permit under the conditions imposed, if any, will not be datrImentel
to the peace, heaith, spfety, and genecal welfere of the Citizens of the City of Aaaheim.
5o That th~ traffic generated by the proposed use wi21 not impose an undue burden
upon the streets and highways designed and proposed to car~y the traffic in the,area.
6. That the numb2r of proposed parking spaces are deemed to be adequate for the
proposed use, under the authority of Code~ Section 18.640070.
. 7. That five persons appeared before the Commission in opposition to subject petition
one of whom presented a petition with thirty-two (32) signatures of neighboring property
owners in opposition to svb~ect petition. •

NOW, THEP.EFORE, BE IT RESOLVED thet the Meheim City Planning Commission does hereby grant subject
Petition for Conditional Use Permit, upon th~ followiag conditions which are hereby found to be a necessary p:erequislte
to the proposed use of the subject property in order to pceserve the safety and genecal welfare of t!:e Citizens of th~
City of AneheiA: •
1. Dedication of fifty-three (53) feet from.the monumented centerLine of Ball Road
(50 feet existfng).
2. Provision of .trash storage areas as determined by the I~epartment of Public Works,
Sanitation Division, which are adequate in size, accessible to trash-truck pickup, and
adequately enclosed by a solid fence or wall, prior to Final Building Inspection.
• 3. Time.limitation of one hundred and eighty (18Q) days for the accomplishment of
Item No. 1. '
4. Development subsiantiallX in accoxdance.with.Exhibit.Nos. L through.8.
5. Construction of a six (6~ foot ~2corative.masonry wa11~ i.n substantial conformance
with the photograph suHmitted, on the west, north, and east.bonndaries of subject property,
provided that said wa11 shall be stepped down to.a.height of _thirty (30) inches within
fifteen {15) feet of the front property line, and to forty-two (42) inches for the remainder
of the distance of said wall along the west and east boundaries of sub3ect property.
