WHEREAS, the City Plenning Commission did hold a public heacing et the Ciey I~all in the City of Aneheim on
July 23~ 1962, et 2:00 o'cloak P.M., notice of said public headng having been duly given es required by
lew end in accotdance with ihe pmviaions of the Aneheim Municipel code, Chepter 18.64, to hear end consider evidence
for and ageinst said p:oposed conditionel use and to investigate and meke findings end recommendetions in connection
thetewith; and
WHEREAS, aeid Commissioa, aEter due inspection, iavestigation, and study raede by itself end in its behelf, end
efter due conaideralon of ell evidence and ceports oEfeced at se:d hearing, does find and determine the followIng facts:
i. That the p:oposed use is prope:ly one for which a Conditionel ,Use Permit is suthorized by this Code, to
wit: establish a walk-up restaurant.
2. That the proposed uee will not edversely affecE the adjoining land uses and the growth end development of
the azea in which it is proposed to be located.
3. That the size and shnpe of the site proposed Eor the use is edequate to ellow the full development of the
pcoposed use in a menner not detrimental to the perticular erea nor to the peace, health, sefety, end genere! welfere
of the Citizens of the City of Anehe~m.
4. Thnt ~the grenting of the Conditionel Use Permit under the conditions imposed, if any, will not be detrimentel
to the peace, health, safety, and general welface of the Citizens of the City of Anaheim.
5. That tHe traffic generated by the proposed use will not impose an undue burden
upon the streets•-and highways designeG and improved to carry the traffic in the area.

Petition for Conditional Use Permit, upon the following conditIons wl~ich are hereby foand to be e necessery prerequisite
to the pioposed use of the subject property ia order to p~eserve the sefety and genewl welfare of the Citizens of the
City of Aneheim: • .
1. Dedication of fifty-three (53) feet from the monumented centerline of Ball Road
(30 feet existing).
2. Preparation of street improvement plans and installation of all improvements for
the road subject to the approval of the City Engineer and in accordance with edopted stand-
ard plans on file ip the office of the City Engineer.
• 3. Payment of ~2.00 per front foot for street lighting purposes on Ball Road.
4. Provision of trash storage areas as determined by the Depari•.ment of Public Works,
Sanitation Division, which are adequate in size accessible to trash-truck pickup aqd
adequately enclosed by a solid f ence or wall prior to Final Huilding Inspection.
5. Time limitation of one hundred and eighty (180) days for tho accomplishment of
Item Nos. 1, 2, and 3.
6. Development substantially in accordance with Exhibit Nos. 1, 2, 3, and 4.
7. Installation of a six (6) foot strip of landscaping along the front property
line of sub3ect property~ said landscaping to be submitted to and subject to the approval
of the Superintendent of Parkway Maintenance, and said landscaping to be installed prior
to Final Building'Inspection.
THE FOREGOING RESOLUTION is elgned aad epproved by me this 23rd day of July~ 1962.
