A RESOLUT?ON OF THE CTfY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT NO. ?44 BE DENIED
NHEREAS, the City Plenning Commission of the City of Maheim did receive a verified Petition for Condltional

Ridgecrest.Drive, Beverly.Hi].ls, California~.Agent of certain real property situated in the
City of Anaheim, County of Orange, State of California, as follows: Commencing at the North-
west corner of the Nor.theast..quarter of the Nnrtheast.quarter of Section 17, in Township 4,
South, Range 10, West,. in the.Ranchn..Lns Cayctes, as shown on a map thereof recorded in book
51, page 7, et seq., Miscellanenus Maps, records of Arange County; running thence South along
the West line of said Northeast quarter of the Northeast quarter 425 ieeti thence East Para-
llel to the North line of said Northeast.quarter of the Northeast quarter 102-1~2 feet; thence
North parallel to the West line of said Northeast quarter of the Northeast quarter, 425 feetj
thence West 102-1/2.feet.to the.point.of beginning; EXCEPTING THEREFROM the north 66 feet of

WHEF.EAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Aneheim on
August 20~ 1962~ et 2:00 o'clock P.M., notice of seid public hearing having beep duly given es required by
law md in accordence with the proviaions of the Anaheim Municipel Code, Chepter 18:64, to }~ear ~nd consider evidence
for and against said proposad conditio:iel use and to investigete and make findinga end recommendetions in connection
therewiW; and
WFiEREAS, said Commission, efter due inspection, investigetion, and study made by itself and in its beheif,
and efter due consideratio~ of ell evidence end repods offe:ed et seid hearing, does find r.nd determine the following fects:
1. Thet the ptoposed use is properly one for which a Conditional Use Permit is authorized by this Code, to wit:
establish a motel.
2. That the pet'itioner proposes two-story construction for the proposed motel within
one hundred fifty (150) feet of existing single family residences abutting subject property
to the west. Upon inquiry by the Commission, the petitioner stated that rie could not agree
to a reduction to one-story on all units to be established within one hundred fifty (150) feet
of the existing single family residences. Futhexmore, the petition was continued for eight
weeks in order to provide the petitioner sufficient opportunity to submit revised plans in
accordance with the recommendations of the Commission. Owing to the fact that the petitioner
has not complied with the recommendations of the Commission, which are deemed to be necessary
to protect the general welfare of the people residing in close proximity of subject property,
subject petition must be denied. This finding is made in view of the fact that motel use
of subject property is considered compatible to the existing and pro3ected development in
the area, if it were developed with appropriate safeguards.
3. That the revised.plans do not incorporate the required thirty-five (35) fooi set-
back from the Lincoln Avenue right-of-way.
4. That two persons appeared in opposition, and two letters were received in•opposition
to sub3ect petition.
