~ A RESOLUTION OF THE CITY PLANNlNG COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE NO. 1529 gE GRANTED

WHEREAS, the City Planning Commisaion of the City of Maheim did recelve e veriged Petition for Variance
from ELIZABEfH DAY, 420 South Beach Boulevard, Anaheim, California, owner of certain real
property situated in the City of Anaheim, County of Orange, State of California,, described
as the West half of the Southwest quarter of the Southwest quarter of the Northwest quarter of
Section 13, in Township 4 South, Range 11 West, San Bernardino Base and Meridian; EXCEPTING
THEREFROM the South 528 feet; ALSO EXCEPTING THEREFROM the West 92 feet thereof
; and
WHEREAS, the City Pleaning Commisaion did fiold a public headng et the City Hell in the City of Anaheim
on October 29~ 1962 ai 2:00 o'clock P.M., notice of seid public hearing having been duly given es required
by law and in accrordance with the provisions of the Maheie~ Municipal Code, Chaptet 18.68, to hear and consider
evidence for end egainst seid pmposed variance and to investigate and make findinga end recommendations in connec-
tion therewith; end
WHEREAS, seid Commiasion, after due inspection, invesHgation, and atudy mede by itself ead in its behalf,
and after due cor:eideration of eli evidence and reports offered es aeid headng, does find and determine the following
facts:
1. Thet the petitionet cec~ueats e varience fmm the Aneheim Municipel Code: SeCtion 18.16.030 (4-b)
requesting a lot split to create two A-A, Residential Agricultural, Zone lots of less than
one acre.
2. That there are exceptional or extraordinery circumstences or conditions eppliceble to !he pcoperty involved
or to the intended use of the propeety lhat do not epply generally to the propecty or class of use in the seme vicinity
and zone.
3. That the requested verience is neceasery for the preservation and enfoyment of a substential propedy right
possessed by othar property in the seme vicinity and zone, end denied to the property in questlon.
4. Thet the requested variance will not be meterially detrimental to the public welfare or lnjurious to the pmp
erty or improvementa In such vicinity and sone in which the property is located.
5. That the requested vadence wil! not edveraely affect the Comprehensive General Plen.
6. That no one appeared in opposition to subject petition.

• NOW, THEREFORE, BE IT RESOLVED thet the Aneheim City Planning Commission does hereby grant subject
Petition for Variance, upon the following conditions which ere hereby found to be e necessary prerequisite to the pro-

` posed use of the subject property in order to preserve the sefety and generel welfare of the Citizens of the City of
'1 Aneheim.
1. Preparation of street improvement plans and installation of all improvements for
~; Beach Boulevard, subject to the approval of the City Engineer and in accordance with the
~ adopted standard plans on file in the office of the City Engineer.

~ 2. Payment of $2.00 per front foot for street lighting purposes on Beach Boulevard.
3. Provision of standard trash storage areas as determined by the Department of Public
Works, Sanitation Division.
4. Installation of fire hydrarits, as determined to be necessary by the City of Anaheim
Fire Department, to provide adequate fire protection.
5. Development substantially in accordance with Exhibit No. 1 as submitted.
6. Record of Survey to be filed with the County Surveyor legalizing the lot split of
su6ject property.
7. Time limitation of one hundred and eighty (180) days for the accomplishment of
Item Nos. 1, 2, 3, 4, and 6.
