A RESOLUTION OF T'r:E CITY PLANNYNCt COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 1534 BE DENIED WHEREAS, the City Plenning Commiasion of the City of Anaheim did receive a vedfied Petition for Verience fxom MEL-KEN OORPORATION~ 2966 Lincoln~ Anaheim, California, Owners; Mv L. McGAUGHY~ 2966 Lincoln, Anaheim, California, Agent of certain real property situated in the City of Anaheim~ County of Orange, State of California described as Lots 1 to 23 inclusive, of Tract No. 4261 as shown on a map thereof recorded in book 161, pages 41 to 43 inclusive, Miscellaneous Maps, records of said Orange County ; and WHEREAS, the City Plenning Commisaion did hold a public headng at the City Hall ip the City of Analseim on November 26~ 1962 at 2:00 o'clock P.M., notice of seid public hearing having been duly given es cequired by law snd in acoordence wlt'h the provisions of the Meheim Municipal Code, Chapter 18.68, to hear and consider evidence for and egeinst seid proposed varlence end to investtgate end make finding's end eecommendetions in connection thertwith; and WHEREAS, seid CommiRaion, after due inspe~tion, invesUgation, and study mede by itaelf and in its behelf, end after due conaideration of all evidence and reports offe:ed as said hearing, does find end determine the following facts: 1. That the petitioner cequests u varience from the Aneheim ~tiiunicipal Code: SeCtion 18.32.090 whiCh requires the establishment of a six (6) foot masonry wall along the east boundary of subject property, to pern~it the waiver of said wall requirement. 2. That there are no exceptional or extraordinary circumstances oi conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 3, That the requested variance is not necessary for the preservation and en~oyment of a substantial property right possessed by other property in the same vici:,ity and zone, and denied to the property in question. 4. That the requested variance will be materiaily detrimental to the public welfare or in~urious to the property or improvements in such vicinity and zone in which the property is located. 5. That the r:equested variance will adversely affect the Comprehensive Genera'1 Plan. 6. T'hat the approval of subject variance is unnecessary and would set an undesirable precedent by predetermining the land use of the property aUutting to the east of subject property. 7. That the release of the subdivisi.on.bond could be obtained from the Engineer3ng Department by substitution of a new bond to cover the installation of the masonry wall only. 8.
