J RESOLUTION N0. 593~ SERIES 1962-63 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITiONAL USE PERMIT343 gE GRANTED WHEF.EAS, the City Plenning Commissioa of the Ciry of Aneheim did rec:eive a verified Petition for Conditionel Use Pecmit from ~~ ~nd.I~AUTHY SENDIETT, 919 North Shafi.er Street, Orange~ California, Owners; L~1hfIS GARRITY, 3030 West_I.incoln Avenue, Anaheim, CaLifornia, Agent of certain real property situated in the .City .of Maheim, County of Orange, State of California described as the West 116.33 f.eet cr the East.216.33 feet of the West half of the North 5 acres of the East half of the Northeast rniartes..of the Nottheast q~+arte.t of Section 14, Township 4 South, Range 11 West, in the Rancho Los Coyotes, as shown on a Map recorded in Book 51, page 11 of Miscellaneous Maps, records of Orange County, California EXCEPTING therefrom the North 66.00 feet ; and WHEREAS, the City Planning Commission did hold a public hearing et the City H~ill in the City of Anaheim oR January 7~ 1963~ at 2:00 o'clock P.M., notice of seid public heariag having been duly given as required by law and in eccordence with the provisions of the Meheim Muaicipal code, Chepter 18.64, to hear and considet evidence for and ageinst said proposed conditionel use aad to investigate and make findiags and recommendatians in connection therewith; and WHEREAS, said Commission, after due inspection, investigation, aad study mede by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine 4he following fects: 1. That the proposed use is properly one for which a Conditional.Use Permit is authorized by this Code, to wit: establish a cocktail lounge in an existing restaurant on subject property. 2. That the proposed use will not adversely affect the adjoining land uses and ihe growth and development of the area in which it is proposed to be located. 3. That the size end shape of the site proposed for the use is adequaEe to allow the full development of the proposed use in a manner not detrimentel to the particular area nor to the peace, health, safety, and generel welfare of the Citizens of the City of Maheim. 4. That the grenting of the Conditional Use Petmit under the conditions imposed, if any, will not be detrimental to the peece, health, safety, and generel welfare of tF.~ Citizens of the City of Anaheim. 5. That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 6. I \\ ~i~'. l ' 1' , `_ ~ --~ NOW, THEREFORE, BE IT RESOLVED that the Maheim City Planning Commission does hereby grent subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and genecal welfare of the Citizens of the ! ~ ' City of Aneheim: • 1. Provision of standard trash storage areas adeqnate to contain all trash as determined by the Department of Public 'Norks, Sanitation Division, prior to Final Building Inspection. i 2. Provision that the addition at the rear of subject property be painted and Y repaired to conform with the architecture of the existing structure. ; 3. Installation of a six (6) foot masonry wall on the southerly property line, or j-°'°°`- the posting of a two year bond to insure the installation of said masonry wall, in the '~ event that the akiutting property to the south is not developed for commercial use. 4. Installation of tree wells in the parkway spaced at forty (40) foot intervals and the installation of landscaping, plans for said landscaping to be submitted to and subject to the approval of the Superintendent of Parkway Maintenance, and said landscaping ;~ to be installed prior to Final Building Inspection. i 5. Development substantially in accordance with Exhibit Nos. 1, 2, and 3, except ;1 as amended herein. 1 6.
