PC 1962-1963-614A• ~ ~ ~ RESOLUTION NO ;'~p ,J 614, SERIES 1962-63 A RESOLUTION OF THE CITY PLANNING COMAQSSION 0~5~fiE CITY OF ANAHEA4 THAT PETITION FOR CONDITIONAL USE PERMIT BE GRANTED WHEREAS, the City Planning Commission of the City of Aneheim did zeceive a verified Petition for Conditionel Use Permitfcom WESLEY E. DIERBERGER, 1215 East Santa Ana Street, Anaheim. California. Owner; ROBERT DIDIC, 127 West Broadway, Maheim, California, Agent of certain real property situatedin the City of Anaheim, County of Orange, State of California, descri.bed as the Easterly 101.2 feet of a portion of Lot 8 of Anaheim Extension, as shocm on a map of survey made by William Hamel, dated and acknowledged December 11, 1868, by A. Robinson, trustee, and f iled in the office of the County Recorder of Los Angeles County, California, described as follows: Be- ginning at the Southwest corner of said Lot 8; thence Northerly along the Easterly line of East Street, 25 rods; thence at right angles Easterly and parallel with Santa Ana Street, 211.2 feet; thence at right angles Southerly and parallel with East Street, 25 rods to the center of Santa Ana Street; thence Westerly 211.2 feet to the point of beginning; EXCEPT the portion on the South within Santa Ana Street; ALSO EXCEPT the Northerly 156 feet thereof ; and WHEREAS, the City Planning Commission did hold a public heering at the City Hall in the City of Anaheim on January 21, 1963~ at 2:00 dclock P.M., notice of seid public hearing having beea duly given as required by law and in accordonce with• the provisions of the Aneheim Muaicipal code, Chapter 18.64, to hear and coasider evidence for and ageinst said proposed aonditional use and to iavestigate and meke findings aad recommendations in connection theeewith; and WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf, and after due consideration of ell evidence and reports oEEered at said hearing, does find and determiaethe following fects: 1. That the pcoposed bse is pcoperly one for which a Conditioaal.U:~ Pe:mit is authorized by this Code,to wit: establish a single story planned-unit multiple family residential development incorpo- rating an existing single family residence on subject property. 2. That the proposed use will not adversely affect the adjoining land uses aad the gmwth and development of the erea in which it is proposed to be located. 3. Thet the size and shape of the site proposed for ffie use is adequete to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, end general welfare of the Citizens of the City of Anahei~. 4. Thet the gwntilg of the Conditional Use Permit under the conditioas imposed, if any, will not 6e detrimental to the peace, health, sefety, and general welfare of the Citizens ofthe City of Anaheim. 5. That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 6. That two persons appeared in opposition to subject petition. Cl-G ~ ; 's ---- _' - ~ -1- 5: f' ~ r 1• i ,j ~ ,~ ~~-~ NOW, THEREFORE, BE IT RESOLVED thet the Anaheim City Plenning Commission does hereby grant subject ~ Petition for Canditional Use Permit, upon the following conditions which ace heceby found to be a necessary precequisite to the proposed use of the subject p:onerty in ocder to presecve the sefety and genecel welfare of the Citizens of the City of Anaheim: ~ 1. Dedication of thirty (30) feet from the monumented centerline of Santa Ana Street (24.75 feet existing). 2. Installation of sidew.alks and driveways on Santa Ana Street in accordance with adopted standard plans on f.i1e in .the office of the City Engineer. 3, Payment of a Park and Recreation Fee of Y25.00 per dwelling unit to be collected as part of the Building Permit. 4. Provision of standard trash storage areas as determined by the Department of Public Works, Sanitation Division, prior to Final Building Inspection. 5. Time limitation of one hundred and eighty (180) days for the accomplishment of Item Nos. 1 and 2. 6. Installation of a six (6) foot masonry wall along the easterly boundary of subject proper- ty, said masonry wall to be installed prior to Final Building Inspection. 7. Limitation of all structures for subject property to one story in height. 8. Revision of plans to incorporate 1~25 garages per dwelling unit. 9. Provision that the drive be increased to a twenty-one (21) foot width from the eighteen (18) foot width as proposed, and that the circulation drive be subject to the approval of the Fire Department and the Director of Public Works, Sanitation Division, prior to Final Buildinq Inspection. , THE FOREGOING RESOLUTION is signed end approved by me this 21st ~~y of January, 1963.
