THAT PETITION FOR VARIANCE N0. 1531 BE GRANTED
WHEREAS, the City Planning Commission of the City of Aneheim did receive a verified Petition for Variance

WHEREAS, the City Planning Commission did hold e public hearing at the City Hell in the City of Aneheim
on Apri2 1~ 1963 at 2:00 o'clock P.M., notice of said ~ublic hearing having been duly given as required
by law and in eccordence with the pcovisions of the Anaheim Municipal Code, Chapter 18.68,to hear and conslder
evidence for end against said proposed varience and to investigate and make findings end cecommendetions in connec-
tion the:ewith; and
WHEREAS, seid Commission, after due inspection, investigation, and study made by itself and in its beha.lf,
and after due consideration of all evidence and repods offered as seid hearing, does find end determine the following
fects:
1. Thet the petitioner requests a variance from the Anaheim Municipal Code: Section 18.16~~030 (4-b) ~
which stipulates the minimum area of R-A parcels other than designated lots in a subdivision,
and Section '18..16,.010, which stipulates permitted Uses in the R-A, Residential Agricultu•ral,
Zone, to permit the constxuction of a duplex on subject propertyo
2. That thece a:e exceptional or extreordinary circumstancas or conditions eppliceble to the propecty involved
or to the intended use of the property that do not epply generelly to the pmperty or class of u3e in the same vicinity
and zone.
3. Thet the requested varience is necessary for the preservation and enjoyment of a substential pmperty rlght
possessed by other property in the seme vicinity and zone, end denied to the property in questlon.
4. That the requested varience will not be materially detrimentol to the public welfere or injucious to the prop-
erty or improvements in such vicinity and zone in which the property is loceted.
5. That the :equested variance wiil not edversely affect the Comp:ehensive General Plen.
6o That the petitionez• stipulated that there would not be any change by reduction of
any rooms in the proposed stxuctures.
7. That no one appeared in opposition to subject petition.

~~ NOW, THEREFORE, BE YT RESOLVED that the Aneheim City Planning Coramission does hereby grant subject
,~ '' Petition for Varionce, upon the following conditions which gre hereby found to be a necessery prerequisite to the pro-
posed use of the subject property in order to p~eseroe the safety and general •welfece of the Citizens of the City of
Aneheim.
la Installation of sidewalks and driveways on Cherry Way and Romneya Drive in
? accordance with the adopted standard plans o1 iile in the office of the City Engineer.
~= 2. Payment of a Park and Recreation Fee rf $25.00 per dwelling unit to.be collected

as part of the Building Permit.
3. Time limitation of one hundred and eighty (180) days for the accomplishment of Item
' No. 1..
4o Development substantially in accordance with Exhibit Nos. 1 and 2, provided that
the plans be revised to indicate two three bedroom units, as requested by the petitioners.
