McCLAIN, 112 East Rosslynn, Fullerton, California, Owner of certain real property situated in the City of Anah~im, County of Orange, State of California, de:,cribed as, PARCEL N0. 1: Lot No. 11, Block 4 of Tract No. 304, as shown on a rap thereof recorded in book 14, page 50, Miscellaneous Maps, records of said Orange~County. EXCEPTING THEREFROM the Westerly 2.75 feet thereof, as granted to the City of Anaheim. PARCEL N0. 2s Lot Nos. 12 and 13, Block 4 of Tract No. 304, as shown on a map •thereor recorded in book 14, page 50, Miscellaneous Maps, records of said Orange County; 'EXCEPT- IA'G THEREFROM the Westerly 2.75 feet thereof, as granted to i;he City of Anaheim ; and WHEREAS, the City Planning Commissica did hold a public hearing et the City Hall in the Ciry of Aneheim on April 15, 1963, at 2:00 o'clock P.M. notice of said public hearing having been duly given es required by lew and in accordence with the provisions of the Anaheim Municipal Code, Chapter 18.72, to heer and consider evidence fac and against seid ptoposed ceclessification end to investigate and make findings end recommendations in connection therewith; end ' WHEREAS, said Commission, after due inspectioa, investigation, end study made by itself and in its behalf, and after due consideration o; all evideace aad ceports offeced at seid hearing, does und and de~termine the following fects: 1. Thet the petitionec proposes a ceclessification of the ebove described prope:ty from the C-2, General Cor~unercial, Zone to the C-3, Heavy Commercial, Zone to establish a used automobile sales lot and off iceso ~ 2. That the proposed reclessification of subject pmperry is necessery and/or desicable toc 4he orderly end pro- per development of the commuqity. 3. That the pcoposed reclassificetioa oE subject propeNy does peoperly relete to 4he zones and their permitted use~ la~ally established in close proximity to subject properry and to 2he zonms and theic permitted uses genecally esteb- lished throughout the community. 4. That the proposed reclassification of subject property does not require dedication for and standard improvement of abutting streets because said property does relate to and abut upon streets and highways which are improved to carry the type and quantity of traffic, which will be generated by the permitted uses, in accordance with the c?.r~:u?ation element of the General Plan. 5. 'r'.',. _ ~ . ~~ -1- ----- -~-------......----____.______.-_..._ _ _._. _ :~ ~ . _ :7 ~ ` : - f~ ", NOVl, THEREFORE, BE IT RESOLi~ED thet the Aaaheim City P'laaning Commission does haeby recommead to the City Council of the City of Meheim thet subject Petitioa for Rtclasai$c~tion be epproved nnd, by so doing, thet Title 1&Zoning of the Aneheim Municipel Code be emended to exclude the ebove described pxoperty from the G2, General Commercial, Zone and to incorporate said described property in the C-3, Heavy Commercial, Zone upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of subject pronerty in order to preserve the safety and gen- erel :velfare cf the citizens of the City of Anaheim. lo Repair of curbs and damaged and/or hazardous sidewalks on La Palma A~enue and Los Angeles Street in accordance with the adopted standard plans on file in the office of the City ~ngineer. 2o Removal and~or reconstruction of substandard driveways on la Pa1ma Avenue and Los Angeles Street in accordance with the adopted standard plans on file in the office of the City Engineer. 3o Provision of standard trash storage areas as determined by the Department of Public Works, Sanitation Division, prior to Final Building Inspaction. 4. Time limitation of one hundred and eighty (180) days for the accomplishment of Item Nos~ 1, 2, and 30 5o That the owner of subject praoerty place on record standard City of Anaheim C-3 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the use of subject property to a used car sales lot or any C-2 uses. 6a That the existing structure on the northerly portion of subject property shall be limited to off ices in conjunction with the used car sales lot, and that any modification of the existing building shall be sub3ect to approval of Development Review.
