THAT PETITION FOR VARIANCE NO. 1563 HE GRANTED WHEREAS, the City Plenning Commiasioa of the City of Meheim did mceive a verificd Petitioa for V~ariance from WILLIAM Ho and MARY C. MEDDQCKs 1844 Haster Street, Ana- heim, California, Owners; CLARENCE MIDDOCK~ 1844 Haster Street, Anaheim, California, Agent of certain real property situated in the City of Anaheim, County of Orange, State of Cal- ifornia, described as the North 210 feet of the following: That partion of the North half of the Northwest quarte,r of ihe Northwest quarter of Section 26, Tawnship 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, page 10 of Miscelianeous Maps, records of Oxange County, California, described as followse Beginning at the Northwest corner of said Section 26; thence Easterly 531.20 feet along the Ivorth line thereof; thence Southerly 651a83 feet parallel with the.Westerly line of said Section 26, io the South line of the North half of the Northwest quarter of the Northwest quarter of said Section 26; thence Westerly 531.20 feet along said South line to the West line of said Section 26; thence Northerly 652>18 feet to the point of beginning ; and WHEREAS, the City Planning Commission did hold a publlc hearing at We City Hell in tI~2 City of Aneheim on April 15~ 1963~ at 2:00 o'clock P.M., notlce of said public hcariag heving been duly given es required i by law and in eccordence with the provisions of the Anaheim Muaicipal Code, Chaptec 18.68,to hear and considec evidence for end against said proposed variance and to inves~igate and make findings and recommendetians in connec- tion therewith; and WHEREAS, said Commiasion, efter due inspection, investigetion, end study mede by itself ead ia its behalf, and efter due consideration of all evidence and cepocts offered as said hearing, does find end determ9nethe followiag facts: ; 1. That the petitioner requests a verience from Ordinance No. 1333, whiCh requires that any ; construction on subject property be of masonry or similar fire resistant material, and from Commission Resolution No. 551, 5eries 1962-63, under which Variance No. 1523 was approved in accordance with plans, to permit the construction of a frame and stucco ranch ' s•tyle service station on subject property with a relocation of driveways and block wall ~ construction~ ; 2. Thet thece are exceptional or extreordinary circumstences or coaditione applicebie :o the property involved or to the intended use of the propezty that do not apply generally to the property or cle~ts of use in the same viciaity and zone. 3. Thet the requested vedence i~ necessary for the ptesecvation aad enjoyment of a substantial property dght possessed by other pcopecty in the aeme vicinity and zone, aad denied to the property in question. 4. That the requested variance will not be meteri~lty detrimeatal to the public welfate or injudous to the pmp~ ecty or improvements in such vicinity end zone in whlch the pmperty is located. 5. That the eequested verience will not advecsely affect the Comp~ehznsive General Plaa. 6. That it is hereby xecommended to the City Council that Ordinar~ce No. 1333 be amended to permit the proposed service station construction. 7. That no one appeared in opposition to subject petition. Development substantially in accordance with Fxhibit No. 1, pxovided that said three and one-half (3~) foot masonry wall not be constructed.closer than thirty-five (35) feei; from the Haster Street property line. 2. Instal.lation of Iandscaping including tree wells, as indicated on Exhibit No. 1, plans for said landscaping and tree.wells to be submitted to and subject to the approval of the Superintendent of Parkway Maintenance, and said landscaping and tree wells to be insicalled prior to Final Building Ir,spection. 3. Subject to the completion of Variance No. 1523.
