PC 1962-1963-724/ :; =;A ~ ~ '~ ~~ ~ ~ ~ ' ~~~ 4, __Y ~ ~,~ RESOLUTION N0.724~ SERIES 1962-63 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM RECUMMENDING T~ 7CHE CITY COUNCIL OF THE CITY OF ANRHEIM THAT PETITION FOR RECLASSIFICATION NO. 62-63-101 BE APPROVED PIHEREAS, the City Plenning Commission of the City of Anaheim did receive a verlfied Petition for Reclassifica- tionfrom ELMER A. and GRACE PFARL PRESTON, 3619.I.ewis Avenue, Long Beach 7, California, Owners of certain real property situated in the City of Anaheim, County of Oranqe, State of California, described as the North 100 feet, South 352 feet of that portion of Lot No. 6, Miles Rancho, as per map recorded in Book 4, page ', Miscellaneous Ma~s, in the off ice of the County Recorder of said Orange County, described as followsi Beginning at intersection of West line of Spadra Road, as so road existed April 29, 1929, with centerline of Romneya Drive; Running thence Northerly along West line of Spadra Road, 712 feet; thence Westerly, parallel ~itn North line of Lot No. 6, for 150 feet; thence Southerly, line parallel with West line of Spadra Road, 712 feet more or less to centerline of Romneya Drive; thence Easterly 150 feet to point of beginning ; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Aneheim on April 15, 1963~ at 2:00 o'ciock P.M. notice of said public hearing having been duly given es required by law and in eccordance with the provisions of the Aneheim Municipel Code, Chepter 18.72, to hear and consider evidence for and ageinst said ptoposed ceclassification end to investigete and meke findings end cecommendetions in connection therewith; and WHEREAS, said Commission, after due inspection, investigat3on, end study made by itself and in its behalf, end efter due considecation of all evidence end reports offered at seid hearing, does find and determine the following fects: 1. That tha petitioner proposes a mclassificetion of the above described pcoperty ftom the C-2~ General Comr.~2rcial, Zone to the C-3, Heavy Cotmnercial, Zone, to permit the establishment of a used car sales lot. 2. That the proposed reclessification of subject property is necessery and/or desiceble for the ocdecly and pro- per development of the community. 3. That the pcoposed reclessification o: subject pcoperty does properIy reiete to the zone3 s.^.d their permitted uses locally esteblished in close proximity to subject property end to the zones and their pecmitted uses generally esteb- lisned throughout the community. • 4. That the prepcsed reclassification of subject propert~~ does require dedication for and standard improvement of abutting streets because said property does xelate to and abut upon streets and highways which are proposed to carry the type and quantity of traffic, which will be generated by the permitted uses, in accordance tivith the circulation element of ~ the General Plan. 5. Heav~ Commercial, Zone upon the following conditions which are hereby found to be a n~c:s~ary prerequisite to the proposed use of subject property in order to preserve the safet+~j a'nd general welfare of the citizens of the City of Anaheim. 1., Dedication of fority-f ive (45) feet fr.om the monumented centerline of Harbo~: Bo~levard (30 feet existing). 2~ Installation of sidewalks and driveways on Harbor Boulevard in accordance with the adopted standard plans on file in the office of the City Fngineer. 3a Provision of a three (3) foot overhang easement along the westerly boundary of the subject property to adequately serve the subject property and other properties, at the t;.me of the installation of the s ervice facilities. 4o Time limitation of one hundred and eighty (180) days for the a ccomplishment of Item Noso 1, 2, 3y and4o ' 5~ Development substantially in accordance with Exhibit No. 1. 6o Installation of tree wells at forty (40) foot intervals in the parkway partion of Harbor Boulevard, plans for said landscaping to be submitted to and subject to the approval of the Superintendent of Parkway Maintenance, and said landscaping to be installed prior to Final Building Inspection.. 7~ Recordation of C-3 Deed Restrictions, limiting the C-3~uses of subject property to used car sales lot only or any C-2, General Commercial, uses. 8~ Construction of a six (6) foot masonry wall, measured from the f inished grade level of subject property, along the westerly property line, prior to Final Building Inspectiono THE FOREGOING RESOI.UTION is sigaed and npproved by me this 15th day of April~ 1963. ~ ~ .
