BE APPROVED WHEREAS, the City Planning Commission of the City uf Anaheia did ceceive e vedfied Petition foc Reclassifica- tionfrom JOHN and RTTA PHIPPS, 1557 Katella, Anaheim, California, O~mers; leROY ROSE~ 600 North Euclzd, Suite 6£iti, Anaheim, ~aiifornia, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, as described in Exhibit "A" attached , hereto and referred to herein as though set forth in fuli ; and WHEREtiS, the City Planning Cammissiort did hold a public hearing et the City Eiall in the City of Maheim on April 159 1963, at 2:00 o'ciock P.M. .notice of said public hearing having been duly given as requiced by law and in accordance with the pcovisions o[the Anaheim Municipel Code, Chepter 18.72, to hear end consider evidence for and against said proposed reclassificetion and to investigate and make findings and recommendetions in connection thecewith; and WHEREf+S, said Commission, after due inspe:.cion, investigetion, and study mede by itself end in its behelf, and after due consideratian of all evidence and reports offered at said hearing, does find end determine the following fects: 1. Thet the petitioner proposes a ceclassificatian of the ebove described pmperty from the R-0~ Residential Suburban, Zone to the C-1, Neighborhood Commercial, Zone to establish professional ~ffices in an existing structure. 2. That the proposed reclassification of subject p:operty is necesasry and/or desireble for the orde:ly and pro- per development of the communiry. 3. That the proposed reclassification of subject property does propeciy relate to the zones end their pecmitted uses locally established in close proximity to subject property and to the zones and their permitted uses generally estab- Iished throughout the community. 4. T.hat the proposed reclassification of subject property does require dedication for and st~ndard improvement of abutting streets because said property does relate to and abut upon streets and highways which are proposed to carry the type and quantity of traffic, which wil~. be generated by the permitted uses, in accordance~dth the circulation element of the General Plano 5o Tha+, no one appeared in opposition to subject petition. Rl-A -1- -._-_' _`Y„~___ _ • s~ l i; NOW, THEREFORE, BE IT RESOLVED that the Aneheim City Plaming Commiasioa does hereby cewmmend to the City Couacil of the City of Annheim that subject Peti4Ion for ReclassiQca~ion be eppmved end, by so doing, thet Title 18-Zoning of the MaheIm Municipal Code be amended to exclude the e6ove described pmperty from the R-0, Residential Suburban, Zone and to incorporat.e said described property in the C-1, Neighborhood Commercialy Zone upon the following conditions which are hereby found to be a neces- sary prerequisite to the proposed use of subject property in order to preserve the safety and general we~fare of the citizens of the City of Anaheim. lo Dedication of sixty (60) feet from the monumented centerline oF Katella Avenue (40 feet existing). 2o Preparation of street improvement plans and installation of all improvements for Katella Avenue, subject to the approval of the City Engineer and in accordance with the adopted standard plans on file in the office of the City Engineer. 3o Payment of $2~00 per front foot for street.lighting purposes on Katella Avenue. 4.. Provision of standard trash storage areas as determined by the Department of Public Works, Sanitation Division, prior to Final Building Inspection. 5. Time limitation of one hundred and eighty (180) days for the accomplisiiment of Item Nos. 1; 2, and 3„ , 6. Development substantiaily in accordance with Exhibit No. 1. 7. Consts•uction of a six (6) foot masonry wall along the north property line, ~rior ~o reclassification of subject propertyo 8o Recordation of C-1 Deed Restrictions limiting the use of subject property to business and professional office use onlyo . 9o Provision that at such time as the northerly portion of subject property is proposed for coimnerc~al development that plans be submitted ta the City Council for approval prior to the issuance of a Building Permit~ l0o Provision that rende•rings shall be submitted to Development Rev'_ew indicating the pro- ~osed changes of the front elevations for commercial use of thz existing structure, for report and recommendation to the City Council in time for the public hearing'on sub~ect petition before the City Covnr,il~ THE FOREGOING kESOLUTION is signed end approved by me :his 15th ddy of April~ 1963.
