'fhet the,petiUoner eequests a variance from the AneheIm Municipei Code: S~Ctio^ 18.32.060 whiCh requires a one=story height limitation within I50 feet where adjacent to an R-A, Residen- tial Agricultural, Zone, to permit the construction of a two-story apartment building on sub3ect propertye 2. Thnt there ere exceptionel ot extraordinery cIrcumatences or conditions applicable to the property involved or to the intended use of the property that do eot apply generally to the propecty or cleas of use fln the same vicinity and zone. 3. Thet the requeated varIence ia neceasnry for the preservatlon end enjoyment of a aubst~ntlel pmperty dg}~~ possessed by other property in the same vicinity and aone, end denied to the ptopedy in question. 4. Thet the requested variance will not be meteriaily detrimentel to the public welfare or inJurious to the pmp. erty or improvements in sach vicinity and zone in which the property is located. . 5. That the requested varience will not adversely affect the Comprehensive General Plen. 6. That no one appeared in opposition, and that one letter was received in support of subject petition. That the owners of subject pr.operty shall pay to the City of Anaheim the sum of $25.00 per dwelling unit~ to be used far park and recreation purposes, said amount to be paid at the •time the building permit ls issued. ~ 5. That trash storage areas shall be provided in accordance with approved plans on ~ file.in the office of the Airector of Public Works, prior to final buildirg inspection. i 6. That Condition Noso 1, 2, and 3, above mentioned, shall be complied with within : a period of 180 days from date hereof, or such further time as the Commission may grante 7. That sub~ect property shall be developed substantially in accordance with pians and specifications on file in t he City of Anaheim, marked Exhibit Nos~ 1 through 4, except as amended herpin. ~ 8.. That the proposed garages be relocated and set back fifteEn (i5) feet from the '~ southerly street in a north-south direction, exposing the garage ends to the southerly ' street, with the provision of ar. adec~uate turning radius for ingress and egress into ihe ~ garages, and that any developmrht plans shall be sub3ect to the approval of Developmen+, ~ Review, prior to the issuance of a Building Permit. i 9. That a fifteen (1~) foot landscaping strip s!aall be provided abutting the ends ; of the proposed garages in the front yard setback of the southerly street in order to ' present a more compatible front yard appearance to the existing residential development ' ad3acent to ti~e south of the southerly street, prior to f inal building inspection. ~ 10.
