A RESOLUTION OF THE CITY PLANNING CG~MMIS3ION OF THE CITY OF ANAEiEIM
TFIAT PETITION FOR CONDITIONAL USE PERMIT N0. 476 BE DENIEL3
WHEREAS, fhe Clty Planning Commission o[ the City of Maheim did receive a vedfied Pe:Ition for Conditional
tlse Peemitfrom SHIRLEY Jo WALL9 1409 Skyline Drive, Fullerton, California, and NANCYANN
LAUDER, 1754 Catalpa, Anaheim, California, Owners of certain real property situated in the
City of Anaheim. County of Orange, State of California, described in Exhibit "A" attached
hereto and referred to herein as though set forth in full
; and
SeptembeiF 16S' ~6gCity Plenning Commission dId hold a public hearing et the City Hell in the City of AneheIm on
at 2:00 o clock P.Af., notice of sald public hearing having beep duly gIven es required by
law end in accordance witt: the ;provisions of the Maheim Municlpel Code, Chapter 18.64, to hear and consider evidence
for and egainst seid pcoposed cr~aditionel use and to investigete and make findings and recommendetions in connection
therewtth; and
1VHEREAS, seid Commission, after due inspection, investlgation, end atudy mede by itsalf and in its behalf,
end after due consideretion o: ell evidence and repoda offeced at sald hearing, doea find and determine the following facts:
1. That the proposed use is pcoperly one for which e Conditionel Uae Permit ie authorized by Ehis Code, to wit:
establish a children's day nursery on subject propertyo
2. i'hat the proposed use will adversely affect the adjoining land uses and the growth
and development of the azea 3n which it is proposed to be locatedo
3. That the size and stape of the site propc;aed for the use is not adequate to allow
the full development of the proposed use in a manner not detrimental to the particular
area nor to tt~e peace, health, safety, and general welfare of the citizens of the City
of Anaheim.
4. That the grana;ing of the Conditional Use Permit will be d.etrimental to the peace,
health, safety, and general welfare oF the cii:izens of the ~;tyof Anal~eime
5. That subject property is located in a single family re~ideotial subdivision, and
the proposed use would be an encroachment of a u,.;iness activity into the neighborhood.
6. That traffic resulting from the commerckal use would create an additional hazard
to an already heavily traveled streeto
7. That th•ree persons appeared, and a ~etition signed by thir•~y-two (32) persons,
was received in opposition to subject petitiono , •
