RECOMMENDINC TO THE CITY COUNCII. OF THE CITY OF ANAHEIM THAT
PETITION 'r OR RECLASSIFICATION NO. 63-64-37 gE APPROVED
WHEREAS, the City Planning Commission of the City of Aneheim did raceive a verified Petition for Fceclassifica-
tionfrom NICHOLAS Jo & LILLIAN DOVALIS, 9281 Fiarriet Lane, Anaheim, California, Owners;
CHARLES Ja HINCKLEY, JRo, 1921 Lodi Place, Anaheim, California, Agent of certain real
property situated in the City of Anaheim, County of Orange, State of ~alifornia, described
'in Exhibit "A" attached hereto and referred to herein as though set forth in full
; and
WHEREAS, the City Plenning Commission did hold a public hearing at the City Hell in the City of Meheim on
September 309 19639 at 2:00 o'clock P.M. aotice of said puUlic hearing heving been duly given es required by
law end in accordence with the provisions of the Anaheim Municipal Code, Chapter 18.72, to hear and consider evidance
for and ageinst seid pioposed reclassifica4ion and to investigate end meke findings and reaommendetions in coanertion
therewith; and
WHEREAS, said Commission, efter due inspecUon, investigation, end study made by itself ond in ita behelf, and
eftar due consideration af all evidence ead repods oEfered at said hearing, does find and determine the following facts:
1. Thet the petitioner proposes a ceclassificetion of the ebove described property from the R-A~ Residential
Agricultural, Zone to the C-1, Neighborhood Commercial, Zone to permit the establishment of
a 16 unit office building on subject property~
2. That the proposed reclessificetion of subject property is necessery and/or desirable far the orderly and pro-
per development of the communiry.
3. That the pcaposed reclassification of subjact pcoperty does properly relete to the zones and their pecmitted
uses locelly esteblished in close pcoximity to subject propecty and to the zones and their permitted uses generally esteb-
lished throughout the community.
4, That the proposed reclassification of subject property does not rec~aire dedication
but do~s require standard improvement of abiatting streets because said property does relate
to and'abut upon streets and highways which are partially improved to carry the type and
quantity of traffic, which will be generated by the permitted uses, in accordance with the
circulation element of the Ganeral Plane
5o That no one appeared in opposition to subject petitiono

.~'' ~ NOW, THEREFORE, BE IT RESOLVID that the Anaheim City Planning Commission does hereby
reco~mnend to the City Council of the City of Anaheim that sub3e~t Petition for Reclassifi-
cation be approved and, by so doing, that Title 18-Zoning of the Anaheim Municipal Code be
~'` amended to exclude the above described property from the R-A, Residential Rgricultural,
_ 2one and to incorporate said described prop~erty into the G1, Neighburhood Commercial, Zone
upon the foilowing conditions which are hereby found to`be a necessary prerequisite to `
i the proposed use of subject property in order to preserve the safety and general welfaze-
:'~:`I of the citizens of the City of Anaheimo
',.;~ lo That street improvement plans shall be prepared and all engineering requirements
of the C~ty of Anaheim along Littcoln Avenue, such as curbs and gutters, sidewalks, street
.~ grading and paving, drainage facilitips, or other appurtenant worY, shall be completed
as requixed by the City Engineer and in accordance with standard plans and specifications
~ on file in the Office of the City Fi.gineer, and that a bond in an amount and form satis-
I factory to the City of Anaheim sba:l'be posted with the City to guarantee the installation
~ of said engineering requiremen•cso
J 2o That the owners of subject property shall pay to the City of Anaheim the sum of
J $2~00 per front foot along Lincoln Avenuey for street lighting purposes< ~
I 3o That txash storage areas shall be provided in accordance with approved plans
~ on file in the office of t}ie Director of ?ublic Works, prior to final building inspectiono
4o That Condition No 0 1 and 2, above irentioned shall be complied with within a period
of 180 days from date hereo~y or such further time as the City Council may granto
5o That subject property shall be developed substantially in accordance with plans
and specifications on file with.the City of Anaheim, marked Exliibit Noo lo
6> That treewells shall be provided at approximately 40 foot intervals in the Lincoln ;
Avenue perkway abutting subject property, that plans for said treewells and planting of.
trees therein, sY[all be submitted to and approved by the Superintendent of Parkway Maintenance~ ,
and said treewells shall be planted with trees prior to final building inspectiono '
j 7o That a six (6) foot masonry wall shall be constructed along the north property
iine prior to final building inspectiono
