RESOLUTYON NO. 1013, SERIES 1963-64 A RESOLUTYON OF THE CITY PLANNIPIG COMMISSION OF THE CITY OF ANAHEIM TIiAT PETITION FOR CdNDITIONAL USE PERMIT 522 BE GRANTED WHERERS, the City Planning Commission of the Cit~ of A:.~;weim did receive e verifled Petition for Conditionel Use Pecmitfrom CENTRAL BAPTIST CHURCH OF JRANGE COUNTY, 227 North Magnolia Street, Anaheim, California, Owners of certain real propexty situated in the City of Anaheim, County of Orange, State of California, as described in Exhibit "A" attached hereto and referred to herein as though set forth in full ; and WHEREAS, the City Planning Commission did hold a public heazing at the City Hell in the City of Aneheim on January 6~ 1964~ at 2:00 o'clock P.M., notice of seid public headng having been duly given as requi:ed by law end in acco:dance with the pmvisions of the Aneheim Municipel code, Cheptee 18.64, to hear and considet evidence for and. egeinst said proposed conditional use and to investigate and meke findings and recommeadatioas ia connection therewith; and . , WHEREAS, seid Commiasion, eEter due inspection, iavestigation, end study mede by itself and in its beholf, aad efter due considecation of ell evidence and reports offemd at said headng, does find and detecmine the following facts: i. That the orooosed nse is omaerlv one for which a Conditional.Vae Pecinit is authodzed by Wis Code, to . - ~ - wit: establish a complete church and school (grades 1-12) including pre-school, offices, gymnasium, swimming pool and outside physical education facilities on subject property. 2. That the size end she~~e of the site propoaed for the use is edequete to allow the full development of the proposed use in a mannet not detrimental to t!~e perticulae erea nor to the peace, health, sefety, end genernl welfare of the Citizens of the City of Meheim. 4. Thet the grenting of the Conditionel Use Permlt under the conditions imposed, if any, will not be detrimental to the peace, health, sefety, and generel walfare of the Citizens of the City of Aneheim. 5. That the'petitioner stipulated that the 2-story classroom -library building proposed to be located 15-feet from the westerly property line would be relocated easterly,~.and that all second story windows would be eliminat~d where said windows would face onto the single family development to the westa , 6. That under the authority of Codes Section 18e64.070, the required 600 parking spaces required for the ultimate 3000-seat sanctuary is hereby waived, to permit the dev- elopment of subject property with 507 parking spaces, based on the fact that the proposed' outdoor bas!:etball courts may be utilized for additional parking area. 7. ' ' J grant sub~ect Petition for Conditional Use Permit, uponjthe followingconditions which are hereby found to be a.necessary prerequisite to the proposed use of the sub~ect property in order to preserve the safety and general welfare of the Citizens of the City of Anaheims lo That all vehicular and pedestrian access rights to Yale, Bruce and Russell Avenues shall be dedicai:ed to the City of Anaheim. 2. That the sidewalks shall be installed along Magnolia Avenue, as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer prior to final building inspection. 3. That the owners of subject property shall deed to the City of Anaheim a 3-foot overhang easement along the northerly boundary of subject property. 4. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along the northerly 250 feet of Magnolia Avenue, for street lighting purposes. 5. That Condition Noso 1, 3 and 4, above mentioned, shall be complied with within 180 days from date hereof, or such further time as the Commission may grant. 6. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked "Exhibit Nos. 1 and 2", provided that all pr.oposed buildings shall be set back a minimum of 25 feet from the west property linea 7, That a 6-foot masonry wall as measured from the highest finished grade level of subject or abutting properties shall be constructed along the west property line where adjacent to the single family residential developed property, within 180 ~tays from date hereof, or prior to the issuance of a building permit for the construction of any structure onsubj~t~ropertys 8. That a minimum 3-foot strip of land shall be landscaped on the Magnolia Avenue frontage and that proposed parking area shall be landscaped and said laridscaping maintained as indicated on Exhibit No. 1 on file with the City; that plans f~r said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 9o That tree wells shall be provided at approximate 40-foot intervals in the Magnolia Avenue parkway abutting subject property; that plans for said tree wells and pianting of trees therein,shall be submitted to and approved by the Superintendent of Parkway Maintenance; and said tree wells shall be planted with trees prior to final building inspection.
