Ownexs; LEONARD SMITH REAL ESTATE, 125°D South Claudina Street,~ Anaheim,.California, Agent of. certain real property situated in the City of Anahpim, County of Orange, State of California, described as all of Tract No. 787 and all of Tract Noe 796, except Lots Nos. 17 through 22 ; and ~~cIEREAS, the City Pianning Conmissioa did hold a public hcaziag at the City Hsll in the City of Anaheim on February 17~ 1964~ et 2:00 o'clock P.61. notice of said public hearing heving been duly given as required by law and in eccordence with the provisions of the Anaheim Municipel Code, Cheptec 18.72, to hear and consider evidence foe and egainst said pioposed realassification and to investigate and make findings end recommecrdetions in coanection thecewith; end WHEREAS, said Commission, eEter due inspection, investIgation, end study made by itself and in its behalf, end aSer due coasideration of ell evidence end reports offeced at said hearing, does find end determine the following facts: 1. That the petitionec proposes a reclassificetion of the ebove described property from the R-A~ Residential Agricultezrals.Zene to the R-3s Multiple Family Residential, Zone for Portion "A" and G1, Neighborhood Commercial, Zone for Por±iori "B"o 2o Thet C-0, Commercial Office, Zone for Portion "B" is deemed a more compatible zone in v.iew of the low-medium density proposed for abutting properties to the west and north, and the existing single family subdivision development to the northwest and northeasto 3'e Thet the proposed reclessificetion of subject property is aecessery end/or desirai;e for the ordecly and pra per development of the commuqity. 4. That the proposed reclassification of subject property does require dedication for and standard.improvement of abutting streets because said property does relate to and abut upon streets and highways which are proposed to carry the type and quantity of traffic, which , will be generated by the permi~tted usesy in accordance with the circulation element of the General Plan. 6. That it is the recommendation of the Planning Commission that the City Council approve a resolution of intent to rezone subject properties, that ordinances be read reciassifying subject properties individually or in a group following completion of certain requirements contained herein,.and that the remaining conditions of approval be completed at the time the building permit is issued or prior to final building inspection. 7. (~- _ .. .__! - , i i„ a !: 3.+i NOW9 THEREFURE9 BE IT RESOLVED that the Anaheim Ci~y Planning Commission does hereby ~ recommend to tlie City Council of the City of ~Anaheim that subject Petition for Reclassification be approved and, by so doing9 that Title 18WZoning of the Anaheim Municipal Code be amended to.exclude the above_described property from ~the R-A9 Residerrtial Agricultural, Zone to the R-3, Multiple Family Residential9 Zone for P~~~ion "A"; and C-0, Commercial Office, 2one for Portion "B" upon the following conditions which are found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and generai welfare of the Citizens of Anaheima lo That prior to the reading of the ordinance reclassifying any portion of subject property a legal description shall be submitted by the property owner covering said propertye 2o That the owners of subject property shall deed to the City of Anaheim a strip of land 32-feet in widthy from the center line of the streety along Orange Avenue and Webster Street, for street widening purposes. 3e That the owmers of subject property shall deed to the City of Attaheim a strip of land 53-feet in width, from the center line of Ball Road for street widening purposeso 4o Tha~ street improvement plans shail be prepared and all engineering requirements of the City of Anaheim along Orange Avenuey Webster Street and Ball Road, such as curbs and gutters,! sidewalks, street grading and paving, drainage f acilities or other appurtenant work shall be completed as required by the City Engineer and in accordance with standard plans and specifica- tions on file in the office of the City Engineer; and that a bond in an amount and form satis•- factory to,the Ci•ty of Anaheim shall be posted with the City to guarantee the installation of said.engineering requiremer.tso . 5. That the owners Qf subject property shall pay to the City of Anaheim the sum of $2000 per front foot, along Orange Avenue, Webster Street and Ball Road, for street lighting purposes. i 6a That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per.dweiling unit to be used for park and recreation purposes, said amount to be paid at the ti.me the building permit is issued~ 7o That trash sotr<.ge areas shall be provided in accordance with approved plans on file in the office of tht.Director of Public Works, prior to final building inspectiono - Ro That fire hydrants sha11 be installed as required and determined to be necessary by the :, Chief of the Fire Department, to be installed prior •to final building inspection, and that a water flow shall be provided which is determined by the F3•re Chief to be sufficient for adequate ; fire protectiono 9o.That a modif3ed cui-de-sac be provided at the terminus of Conley Street subject to the ' approval of the City Engineero This is rec,uired of the property owner located east of thE? terminus on Conley Streeto l0o That the owners of subject property shall pay to the City of Anaheim the sum of 15¢ per front foot along Webster Street, Orange Avenue,' and Ba11 Road, for tree plantinq purposes; said amount to be paid at the time the building permit is .fssued or within a period of 180 days from dat~ hereof, whichever occurs firsto 1'1> That the plans of development for any portion af subject property shall be submitted to Development Review for report and recommendai:ion to the Planning Cornmission and City Council, 3nd that said plans shall be subject to the approval of the Commission and Council9 provided tha't any plans for any property under ~ortion "A" shall be limited to a density not to exceed 18 dwelling units.per. net residential acre or building site, and shall be limited to one-story i, construction within 150 faet of any property ~lassified in the R-ly One Family Residetttial9 Zone,i and further provided that'plans for Portion "B" shall conform to all provisions of the C-09 !
