'_. ~.' 6> l~. • L, 4; 1,~i P.ESOLUTION NO. 1079, SERIES 1963-64 A RESOLUTION OF THE CITY PLANNING COMhIISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 1b23 BE GRANTED WHEREAS, the City Planning Commission of the City of Aneheim did receive e vedfied Petition for Vedence from.: MlkRCUS A..GARTNER,. 1233 North Harbor.Boulevard9 Anaheim,. Calif~xnia,.Owner of certain r.eal property situated in the City of Anaheim, County of Orange, State of California, described as Lot Noo 8 oi Tract No. 530 ; and WHEREAS, the. City Planning Commission did hald a public hearing et the City Hall in the City of Anaheim on MarCh 2~ 1964~ at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by law and in accordence with the provisions of the Maheim Municipal Code, Chapter 18.68,to hear and considee evidence for' and egeinst seid proposed variance and to inves~igete and meke findings end recommendations in connec- tion the:ewith; and WHEREAS, said Commisaion, after due inspection, investigat?on, and study made by itself end in its behelf, and after due consideration of all evidence and reports ofEeced as seid hearing, does find and determine the following facts: 1. That the petitioner requests a varience from the Anaheim Municipel Code: SeCtion 18028.030(b) which requires a 20.foot reai yard for subject property, 180800080, which requires that any single family.dwelling..shaLl have a minimum of 1225 square feet, to permit the development of subject property with a 17~ foot rear yardy a 19000 square foot bLilding, and the constr.uction of a 704 square fooi, dwelling unit over a~three-car garagee 2. That there are exceptionel or extreordinery circumstences or conditions eppliceble to the property involved or to the intanded uae of the p:operty that do not epply genecally to the pzopecty or class of use in the seme viciaity and zone. ~ 3. That the requested varience is necessery for the preservation end enjoyment of a subatential property right posseased by other p:operty in the seme vicinity and zone, end denied to the p:aperty in question. 4. That the eequested varience will not be meterially detrimental to the public welEete or injurious to the pmp- erty or impTOVements in such vicinity and zone in which the property is locetxd. 5. That no one appeared in opposition to subject petition. That .the damaged and~or hazardous sidewalks and curbs shall be repaired along Sabina Street,.as..r.equixed by the City Engineer and in accordance with standard plans and specif ications on.file in the office of the City Engineer prior to final building inspection. 2. That the.owner of subject property shall pay to the City of Anaheim the sum of $25.00 per.dwelling.unit, to be used for park and recreation purposes, said amount to be paid at the time..the~building permit is issued. 3..That trash storage areas.shall be provided.in accordance.with approved plans on file in the off ice Df the Dixector of Public Works, prior to final building inspection. 4..That ';he owner.of subject property shall pay to the City of Anaheim.the sum.of 15~ per front foot along Sabina Street, for tree planting purposes; said amount to be paid at the.time..the.building.permit is issued or within a period of 180 days from date hereof, whichever occurs first. 5.
