Use Permitfrom EI.BFRT L AND LIDA SMITH9 12921 Wheeler.Place, Santa Ma9 California, Owner;

situated in the City of Anaheim, County of Orangey State of California, as described in
Exhibit "A" attached hereto and referred to herein as though set forth in full

WHEREAS, the City Plenning Commission did hold a public heexing at.the City Hall in the City of Aneheim on
MarCh 169 1964,, at 2:00 o'clock P.M., notice of seid publlc heacing having been duly given as required by
law at~d 1n ecr~tdence with the pcovisions of the Aneheim Mnnicipal code, Chapter 18.64, to hear and coasider evidence

thecewith; end
WHEREAS, said Commlasion, efter due inspection, inveatigetion, end study mede by itself end in its behalf, end
efter due consideration of ell evidence and zeports offered at seid headng, does find end datermine the following facte:
1. That the proposed uso ta properly one foe which a Conditional,Use Permit is authorixad by thie Code, to
witi establish a 82-un'it motel in cor.janct3.on w~th a family restaurant on subject property<
2. That the proposed use will aot adversely effect the: adjoining lend uses end the growth eud development of
the acea in which it is pcoposed to be located.
3. Thet the size and ahepe of the site proposed fos the use is adequate to allow the full development of the
proposed use in a mannec not detrimentel to the pacticular area noe to the peece,, h~alth, safery, end gene:al welfere
of the Citizens of the City of Meheim.
4. Thet the gcanting of the Canditlonal Use Permit under the conditions imposed, if eny, wIll not he detrimental
to the peace, health, safety, and general. welfere of the Cit:lzens of the City of Aneheim.
5o That the'petitioner stipulated that the 50-foot landscaped setback would be maintained
and that the plot plan shouid be amended to reflect this 50-foot setbacko

t~Vl, THEREFDREa BE IT RESOLVID that the Anaheim City Planning Commission does hereby
grant subject Petition for Conditional Use Permit9 upon the following conditions which are}erebyj
found to.be a necessary prerequisite to the proposed use of the sub~ect propesty in order to
pseserve the safety and general welfare of the Citizens of the City of Anaheim~
lo That the owners of subject property shall deed to the City of Anaheim a strip of land
for.ty-five (45).f.eet in width9 from the center Iine.of the.street, along Manchester Avenue9
for street tvidening purposeso .
2~ That street improvement plans shall be prepared and all engineering requirements of
the City of.Anaheim alnng lAanchester Avenue9 such as curbs and gutters, sidewalks9 street
grading.and paving, drainage facilities9 or other appurtenant work shall be completed as re-
qu3red by .the City Engineer and in accordance with standard p'lans and specifications on file ~
in the.off.ice of the City Engineer; and that a bond in an amount and form satisfactory to the ',
City of Anaheim shall be posted with the City to guarantee the installa•tion of said engineering
requirementsa
3o That the sidewalks shall be insta~Xed alonq Harbor Boulevard9 as required by the City
Engineer and in accordance with standard plans and specifications on file in the office of the
City Engineera
4a That the owners of sub~ect property shall pay to the City of Anaheim the sum of $2000

5o That trash storage areas shali be pxovided in accordance with approved plans on file
in,+hg.pffiG~.of.the Director oP Public Works4 prior to final building inspectione
6o That.fire.hydr.ants shall.be installed.as.requir.ed and determined to be necessary by
the Chief,of the Fire Ae{~artment, to be installed prior to final building inspectione
7a That.Condition Noso 1, 2, 39 and 49 above mentioned9 sha11 be complied with within a
periad of.180.days.from date hereof9 or such.further time as the.Commission may grant.
8e That subject property shall ba developed substantially in accordance with plans ~nd
apecificat3ons on file with the Cit~y of Anaheim9 marked.Exhibit Nosa 1 through 7, as amended
provided.that a 50-foot setback shail ba landscaped and maintained as stipulated by the
petitionero
