TFiAT PETITION FOR VARIANCE N0. 1530 BE GRAiVTED
NHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition fo: Yadance
from JOH,y Fo KRAMER, 114I East Ash Avenue, Fullerton, California,.Owner; J.OE LANE, 212 Ash,
Anaheim, California, Agent of certain real property sitnated in..the..City.of.Anaheim,..County
of~.Orange, State of California, as described in Exhibit "A" attached tiereto and referred to
herein as though set forth in full '
; and
WHEREAS, the City Plenning Commission did hold e pubHc heering at the City Heil in the City of Aneheim
an March 30~ 1964~ at 2:00 o'clock P.Nl., notice of said public headng heving been duly given as requieed
by law and in accordance with the p:ovisions of the Anaheim Municipel Code, Chepter 18.68,to hear and consider
evidence for and egainst said proposed varience and to inves~igute and make findings and recommendations in connec-
tion therewith; and
WHEREAS, said Commission, after due inspection, investigatlon, and study made by itself end in its behalf,
end after due consideration of all evidence er.d repods offered es said hearing, does find and dete:mine the following
facts:

which requires garages, to permit the construction of carports in lieu thereof.
2. That thece are exceptional or extraordinery ciccumstances or conditions applicable to the property involved
or to the intended use of the property that do not epply generally to the property or class of use in the seme vicinity
and zone.
3. That the cequested variance is necessary for the pcesecvation and enjoyment of a substantiel property right
possessed by other property in the same vicinity end zone, and denied to the pmperty in question.
4. That the requested veriance will not be materially detrimental to the publlc welfare or injurious to the pmp-
erty or improvements in such vicinity end zone in which the property is loceted.
5o That the precedent for two-stox•y construction on the property abutting to the north
of subject property was established by the City of Fullerton, and has created a situation
which has madz it impractical to develop subject property with either single family dwelling
units or single story.multiple family dwelling unitso
6o T::at two-story construction will act as a buffer for the single family subdivision,
by reducing the noises emanating from the Santa Ana Freeway abutit3ng the westerly property
line of subject propertyo
7. That no one appeared in opposition •to subject petitionn

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Plenning Commission does hereby gcant~snbject
Petition for Veriance, upon the following conditions which are hereby found to be a necessary prerequisite to'tfie pm-
~ posed use of the subject pcoperty in order to preserve the safety end general welfere of the Citizens of the City of ,
Anaheim.
lo That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 ~
per.dwelling unit, to be.used for park and recreation purposes, said amount to be,paid'at the
t.ime.the building.permit is issued.
2. That trash storage areas shall be provided in accordance wi~h approved plans on fi~P '
in the office of the Director of Public Works, prior to final building inspection. ',
3o That this Variance is granied subject to the completion of Reclassification
No. 63-64-99.
4~ That fire hydrants shall be installed as required and determined to be necessary by
the Chief of the Fire Department, to be installed prior to final building inspection.
5. That subject property shall be developed substantially in accordance with plans and
specifications on fiie with the City of Anaheim, marked Exhibit Nos. 1 and 2. .
6. That a.6-foot masonry wall shall be constructed along the east and southwest property
lines prior to final building inspec•tiono '
7. That the rear and side walls of the proposed carports shall be finished with exterior
building materials, that enclosed storage cabinets of a minimum capacity of 100 cubic feet ~
shall be provided at the rear wall of each carport, and that adequate bumper guards shall be
provided to protect the interior walls of the carports prior to final building inspection. ,
