WHEREAS,' the City Plenniag Commission of the City of Aneheim did receive a verified Petition for Vedance

of California, described as Lots Noso 11 and 12 of Tract No. 3328

WHERcAS, the Ci4y Plenning Commission did hold a public hearing at the City Hall ir. the City of Aneheim
on May 11 ~ 1964~ et 2:00 o'clock :'.M., notice of said pnblic headng heving been duly given as requiced
by law and in eccocdance with the pcovisians of the Aneheim Municipel Code, Chapter 18.68,to hear and considee
evidence for end egainst said proposed variance end to invesugate and meke findiags and recommendatioas in connec-
tion the:ewith; end
WHEIREAS, said Commissian, after due nnspection, investigatlon, ead study made by itself and in its behalf,
and after due consideration of ell evidence and reports offered as said hearing, does find end detecmine the following
facts:
1. Thet the petitloner requests e varience from the Meheim Municipel Code: Section 1A,32o0R0(3~~ which
requires that each lot shall have a rear yard access area extending the full width of the
lot of a depth of not less than 25 feet, and Section 1R,32o060, which requires that where
a R-3 lot abu~ R-A property, the height limitation shall be one story, to permit the dev-
elopment of Lot Nosa 11 and 12 of Tract Noo 332R with an encroachmeht of 1706 feet into
the required rear yard and to construct two-story apartments on subject propertyo
2. That there ece exceptional or extraordinary ciacumstences oe conditions applicable to the propecty involved
oe to the intended use of the pcoperty that do not apply genecaily to Qhe property or class of use in the same vicinity
end zone.
3. That the requested varience is necessary for the p~eservation and enjoyment of a substentiel property right
poasessed by other pcoperty in the seme vicutiry and zone, end denied to the ptoperty in question.
4. That the requested variance will not be materiaily detrimental to the publlc welfate or injurious to 4he pmp-
erty or improvemenis in such vicinity and zone in which the property is located.
5o That no one appeared in opposition to subject petitiono .

Petition fo~ Veriance, upon the following conditions which ere hereby found to be a necessery pcerequ:aite to the pm-
posed use of the subjecl propecty in ozder to presecve the sefety end general welfare of the Citizena of the City of
Aneheim.
lo That trash storage areas shall be provided in accordance with aj~proved p].ans.on
file.in the.office of.the Director of.Public.lNorks, prior to final building inspectio~.
2. That..the otirner of subject ~+rs~erty shall pay to the City of Anaheim the sum of
$25.OO.pex:.dwelling unit, to be..used for park and.recreation.purposes, said amount to be
paid at the time the.building permit is issued.
3. That subject..property shall be develo~ed substantially in accordance with Exhibit
