BENSON, 1803 North Old Tustin Road, Santa Ana, California, Agent of certain real property situated in the City of Anaheim, County of Orange, State of Cali:cr~ia, desc: ~ed as b~ginning at a~oint 80 feet Sputherly from the North- east corner of Vineyard Lot A-1, as per mep thereof recorded in book 4, pages 629 and 630, Deeds, Records of Los Angeles County; running thence Nlesterly parallel with the Norther~y line of saidlot, 164 feet; thence Southerly parallel with the Easterly line of said lot, 75 feet; thence Easterly parallel ~vith the Northerly line o: said lot, 16d feet; thence Northerly 75 feet to the point of beginning; ALSO, beginning at the Northeast corner of Vineyard Lot "A1", as shown on a map record- ed in book 4, pages 629 and 630, Deeds, records of said Los Angeles County, running thence Westerly along the Northerly line of said lot, 164 feet; thence Southerly parallel with the Easterly line of said lot, 80 feet; thence Easterly parallel with the Northerly line of said lot, ;and 164 feet, and thence Northerly to the point of beginning WHEF.EAS, the City Plenning Commission did hold a gublic h~srino at the City Hell in the City of Anaheim on May 11 ~ 1964 at 2:00 o'clock P.M., notice of seid public hearing hnving bec~ duly given as requiced by lew end ia accocdaace with the provisions of the Anaheim Munidpal Code, Cheptea 18:64, to heaz end consider evidence for and against said pcoposed rnnditioaal use aad to investigete aad make findings end cecommendations in connectIon therewith; end ' WHEREAS, aeid Commission, after due inspection, investigetion, end study mede by itself end in its behalf, and after due consideration of ell evldence ead reporQs o;rored at seid hearing, does find and detecmine the foU.owing fac,ts: 1. That the proposed use is pcoperly one for which a Conditionel Use Permit is authorized Uy this Code, to wit: establish a service station on subject propertye 2o Tha+. the proposed use will adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be locatedo 3o That, although two servic~e st~-tions have b~en approved near subject property, these service stations are located at the intersection of two arterial highways, namely La Palma Avenue and East S1;reet~ that sub~eat property is located at the intersection of a local street and an arterial highway and further, that North Street should be used as the southerly boundary of commercial development at the La Palma Avenue and East Street intersectiono 4o That the significance of North Street, n~w functioning as an arterial hgihway, will be substantially altered when La Plama Avenue is extended westerly from East Street across the railroad right-of-way, particularly if the Public Utilities Cormnission requires the closing of North Street across the railroad right-of-way. 5o That no o~e appeared in oppositian to subject petitiuno ~ ~ ~ i ~ 1 ~-. . .~ ~ - : " ,, ,, - (,_ ? {~-'€ NOW,.THEREFORE, BE IT RESOLVED thet the Aneheim City Planning Commission does hereby deny subject Petition foi Conditionel Use Permit on the besis of the afocementioned findings.
