A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM

WHEREAS, the City Plenniag Commission of the City of Anaheim did receive a veri8ed Petition for Vedunce
from ORANGE COUMY DEVELOPMENT CORPORATION, 310 Rosebay Street, Anaheim, California~ Owner;
JACK 1}a IVC CLEAN, President, Orange County Development Corporation, 310 Rosebay Street,
Anaheim, California~ Agent of certain real property situated i.n the City of Anaheim, County
of Orange, State of California~ described as Lots Nose 1 through 12 of Tract Noo 5113
; and
~ WHEREAS, the City Planning Commission did hold e public headng at the City Hell in the City oE Anaheim
on May 11 ~ 1964~ at 2:00 o'clock P.M., notice of seid public headng heving been duly given es required
by law end in accordence with the proviaions of the Aneheim Municlpel Code, Chepter 18.68,to hear and consider
evidence ior end ageinet said proposed verience and to inves~igate and meke findings end cecommendatIons in connec-
tion therewith; end
NHEREAS, seid Commiasion, efter due inspection, investigation, and study made by itself nnd in its behalf,
end a£ter due consideration of all evidence and ~epods of:emd as seid headng, daes find and determine the following
facts:
1. Thet the,petitioner requests e verience from the Anaheim Municipal Code: SeCtion 1R~04o090 (4) whiCh
requires that a'6-foot.fence, wall or hedge may be erected in the normal side and rear yards
to permit the establishment of 30 inch high addition to an existing 6-foot masonry ~vall along
the.west psoperty line of sub~ect property~
2. Thet there are exceptionel or extreo:dinery ciecumstences or conditiona eppllceble to the propecty involved
or to the intended use of the property thet do not epply generelly to the propedy or cleas of use in the seme viciniY~
end zone.
3. That the requested varlence ia necessery for 4he preservetion and enjoyment of e aubstential property rlght
possesaed by other property in the seme vicinity end zone, end denied to the ptopedy in question.
4. That the requested varience will not be meterially detrimentel to the public welfete or injurious to the pmp-
edy or improvements in such vicinity end zone in whlch the property is loceted.
5. That the requested verience will not edversely affect the Comprehensive General Plen.
6e That the purpose oP the proposed addition to the exi.sting wall is to visually screen
the single family homes from the commercial development to the west of subject propertyo

NOW, THEREFORE, BE IT 12ESOLVED that the Anaheim City Plenning Commission does hereby gcant subject
Petition for Vadance, upon the following conditions which are hereby found to be a necessary prerequIsite to the pm-
po~ed use of tl~e subject property in o:der to preserve the safety and general welfece of the ~itizens of the City of
Meheim.
le That subject property shall be developed substantially in accordance with plans and
speciiica~tions on file with the City of Anaheim, marked Exhibit P1o. 1 and construction of the
additional fencing shall be subject to the approval of the Building Departmento
