A RESOLUTION OF THE CITY PLANNIPi(G COMMISSION OF THE CITy OF ANAHEIM
THAT PETITION FOR VARUNCE NO. 47 BE DENIED
WHEREAS. the City Plaming Commissioa oE the City of Aaaheim did receive a veriged PetlUon for Vadance from
EDWARD E. FISF~R, STUART L. JOHNSON AND PAUL AND CLADA M. PLETZ, 125 East Ball Road,
Anaheim, California~ Owners~ LE ROY ROSE, 600 North Euclid, Suite 686, Anaheim,
California~ Agent of ~ertain real property situated in the City of Anaheim, County
of Orange, State of California, as described in Exhibit "A" attached hereto and
referred to herein as though set forth in full

1YHEREAS. sdd Commissioa, after due inspectloa, ineestlgatlen, aid stndy made by itee9f end ia its be6alf,
end eher due con~ideration of all evIdence and repode oifaed as said hearing, does find aad dRteemiae the foUowing
facts:
1. That the petitioner ceqnests a vartance hom the Aeahe+- -'unicipd Codo: Section 18e32. J80(2) which
re~quires that the minimum side yard be nat less than 7~ feet in width and 18,31,.120 which
requires 1~ spaces per dwelling unit in a garage to construct t;arports in lieu of the required
garages in the required'side yard; and 18~32v060 which requires that the~he3ght~of anystructure
within 150 feet of R-A, Residential Agricultural9 Zoned property be one story in height to
permit the constrvction of two-story structureso
2o That the requested varience will be materially detrimental to the•public welfare or
in~urious to the property or improvements ir. such vicinity and zone in whtch the property is
locatede
3o That although the proposed multiple-family development is in conformance with the
City's land u'se policy as reflected upon the General Plany th~ specific site development
standards; as reflecteb in the exhibits submitted by the petitioner, are tnconsistent with
the Planning Cortunission's recominended amendments to the existing R-3, Multiple-Family Resi-
dentiai9 Zon~ and furth'er, that although said amendments have not been adopted by the City
Council, they provide for a level of living environment which should be irrcorporat~d into the
development of subfect property.
4e That although the Commission asked that the petitioner submit revised plans incor-
porating suggested changes, the petitioner stated that it would be impractical to prepare
revised plans, and requested that the Co~nission act on the plans which had been submittede
