AMENDING RESOLUTION N0. 1095~ SERIES 1963-64
APPROYING CONDITIONAL USE PERMIT N0. 544

W}~REAS~ the City Planning Commission on March 1(r, 196d~ approved Conditional
Use Permit No. 544 in Resolution No. 1095, Series 1963-64, to estahlish an 82-unit
motel in conjunction with a family restaurant~ and
WF~REAS, a request from the agents and proposed lessees for the petitioners
was received stating that Condition No. 1 of the above aentioned Resolution could
not be caaplied with without nullifying the proposed development, and
WFIEREAS, the City Attorney's Office rendered an opinion that dedication of a
strip of land for street widening purposes could be accepted from the lessees rather
than the petitioners for a period of 45 years provided that the Conditional Use Permit
be terminated upon expiration of said lease unless a deed of easement is presented by
the fee title holder for said dedicatione
NQIY, THEREFORE, BH IT RESOLVED THAT the City Plannirrg 6vmmission of the City of
Maheim does hereby amend by this action Resolution Noe 1095; Series 1963-64, Condi-
tion No. 1 to read as followse
"That the lessees of subject property shall deed to the City of Anaheim
a strip of land forty-five (45) feet in width from the centerline of the
. street along Manchester Avenue, for street widening purposeso"
AND FURTHER BE IT RESOLVED that an additional condition be attached as followse
"lla That this Conditional Use Permit shall expire upon the termination
of the 45-year lease, unless at such time the aforementioned dedi.cation
is obtained from the fee title holder of subject property."
