law and ia eoooedence alth the proviaions of the Meheim Municlpel Code. Chapter 18.68, to hear and consider evidence for

WfiEREAS, said Commtaston, efter due inspectioa, invesUgatioa, and etudy made by itself ead la its behalf;
and after due coneideretion of ell evidence and repods oiferod es said headag, does fiad and deteemine the foUowiug
facte:
1. That the petitioner requests a vadence from the Meheim Municipal Code: Section 18.240030(3) to pexmit
an addition to an existing residence to encroach to within seven feet of the rear lot line.
2. Tha~ there are no exceptional or extraordinary circumstances or conditions applicable
to the property involved or to the 3ntended use of the property that do not apply generally
to the property or class of use in the same vicinity and zonee
3. That the requested va•riance is not ~ecessary for .the preservation and enjoyment of
a suhstantial property right possessed by other property in the same vicinity and zone, and
denied to the property in question.
4. That the property owner appeared in opposition to subject petitione
