RESOLUTION NOo 1475 SFAIES 1964-65 A RESOLUTION OF THE CITY PLANNING OOMMISSION OF THE CITY OF ANAHEIM REWMMENDING TO THE CITY ~UNCIL OF THE CITY OF ANAHEIM THAT THE CITX ODUNCIL ADOPT A RESOLUTION WNTAINING STANDARDS FOR THE GUIDANCE OF PERSONS OR ENTITIES SEEKING APPROVAL OF aDVENANTS, CONDITIONS AND RESTRIC- TIONS WHICH MAY BE RFl~UIRID TO BE FILED BY SECIION 17008,300 OF THE ANAHEIM MUNICIPAL C~DE it is the desire of the Planning Commission of the City of Anaheim WHEREAS ~ , to recommend to the City Council of the City of Anaheim the implementation of the provisions of Sectio~ 17~080300 of the Anaheim Municipal Code governing the review and approval of convenants, conditions-and restrictions to be submitted to said '" Council in conjunction with the therein described subdivision of real property or airspace, and WHEREAS, it is the further desire of said Commission to establish some standards for the guidance of persons or entities seeking the approval of covenants, conditions and restrictions for the aforementioned and described subdivisions by this Commission, and VYFIEREAS, it is the further desire of said Commission in establishing said standards for such guidance to insure, insofar as possible, the privacy of each owner of real property or airspace through protection of each of said owners from trespass to his real proper;.y or airspace by any other such o•~vner within said subdivision, and WHEREAS, it is the further desire of said Commissicn in establishing said standards for guidance to insu.re, insof ar as possible, the perpetuai maintenance of all areas and improvements within said subdivision which are proposed to be either (1) owned in common or maintained in common by each of ±he owners of real oroperty or aixspace or (2) all areas and improvement proposed to be owned by a pe~son or entity separate from persons or entities owning individual parcels of real property or airspace within said subdivision, and WHERFJIS, i1: is the furthe* desire of said Commission in attempting to insure, insof ar as possible, perpetual maintenance of the aforementioned and described areas within said subdivisions to avoid a situation in which such areas may decline into ~ such a state as to consti•tute a possible future maintenance problem and financial ~ burden for the City of Anaheime ~ NOW, THEREF~RE, BE IT RESOLVED that the Maheim City Planning Commission hereby ~ recommends that the City Council of the City of M aheim adopt a resolution containing the following standards for the guidance of persons or entities seeking to divide land as permitted in SectioriZ7oD$~'00 of the Anaheim Municipal Code and recommends that the " Check List City Council of the City of Anaheim adopt that certain document entitled, ~ of Provisions to be inciuded in Convenani;s, Conditions, and Restrictions to be submitted to t.he City of Maheim for approval9" referred as Exhibit "A" attached hereto and , referred to as though set forth in full in order that more specific guidance may be , given to developers and subdividers in implementing said standards; I I i i li I X i fr ~ • i $ ~ ~ ~ --- `~ ~ .~ '•~i - ~ 1. Such persons or entities shall make providions for an irrevocable fund for the perpetual maintenance of the aforementioned areas owned or maintained in common and shall make specific provisions for the amount of the initial deposit of money into said fund at the time of +.he sale of each parcel of land or airspace real property divideo pursuant to Section 17v08a300 and shall specify the total amount of such money to be deposited initially in said fund. 2. Such persons or entities shall specify in covenants9 conditions and restrictions or other legally binding instrument or document the amount, if any, to be periodically contributed to the aforementioned irxevocable fund by each owner of a parcel of real estate or airspace. 3o The Commission and Council shall review the aforementioned amounts of money to determine whether such sums a*e sufficient in terms of the estimated cost of maintenance of the aforementioned and described areas and improvements owned or maintained in common which estimated cost figures are to be supplied by the persons or entities subdividing land or airspaceo 4~ Such persons or entities shall specify in said convenants, conditions, and restrictions the method by which it is proposed to insure, insofar ~' as possible, the privacy of each owner of such a parcel of land or ? unit of airspace by protecting each of said owners from trespass to said parcel or unit by any other such owner within sair? subdivision, and '+ BE IT FURTHER RESOLVED that in establishing the foregoing standards the `.; Commission recommends i:hat the City Council not preclude such person or entities ' from proposing alternative methods of accomplishing the foregoing objectives of ~'' maintenanca~ and privacy if such alternatives methods are sufficient to accomplish ;i said foregoing objectivese :; THE FOR~ING RESOLUTION is signed and approved by me this 3 day of December, ~ 1964. ~ ~ .
